May 7, 2025 at 3:30 amRedevelopment concern! how to trust the developer when he doesn’t provide proper details of project, asking existing members to buy Car parking.Society got a proposal from builder saying free parking for all 1bhk, and 25 percent increase carpet area for every flat.
After 2 months of back and forth and lots of meetings he is now asking members to buy parking for 5 lakhs each. Stating without parking his flats won’t get sold if he gives free parking to all members. He doesn’t want to share plan or measurements despite repeated requests. he wants to sell parking but not giving it in writing.
MC is Cahoots with builder and pushing others to buy parking which is against the bye laws.
What would you do if you were in such a situation, please note most members are retired folks or have meager income and builder got this internal information and is twisting the deal.
No mou or agreement signed, 3x members are ok to buy the parking but 1x members don’t want to buy it and can’t afford it.

May 7, 2025 at 7:02 am1. This is a classic developer scam, they initially promise free parking to get your agreement, then try to change terms and extract more money later.2. Supreme court further stated that the builders or promoters cannot sell parking areas as independent units or flats as these areas are to be extended as โcommon areas and facilitiesโ for the owners. Also, the Court said that the developer is only entitled to charge price for the common areas and facilities from each flat purchaser in proportion to the carpet area of the flat. [Nahalchand Laloochand Pvt. Ltd. v. Panchali Co-operative Housing Society Ltd. [AIR 2010 SC 3607]]
