        I stay in Banglore and have been planing to shift to a new house.
        Today the owner mentioned the property is on his wife’s name and I will be signing a contract with her.
        But she does not have a PAN Card so I can’t claim HRA or anything of that sorts.

        Also he’s asking to pay deposit and rent in cash???
        I am not sure if this is a legal and valid rent agreement. What are the requirements in Karnataka for a contract to be valid? I am afraid he will sign an invalid contract and make troubles later

          Why you will need hra in new regime?

              I just want the contract to be legit, if I am claiming HRA it will make sure she is earning some money, but if I pay in cash there is no proof of me paying the money or them earning any!

                  It is totally cash deal. If you are not ok then dont rent because she doesn’t have pan or they are not willing to give.

                  Paying rent as cash is not illegal. Claiming HRA from your employer does not need owner PAN. You need it only to claim tax deduction, which is not possible under new regime.

                  Get a rent receipt signed every month when you pay cash. Add this a clause in the agreement that rent receipt will be signed by the owner every month.Β

                    Deposit paid and that rent is going to be paid in cash has to be mentioned in the agreement. There should be reciepts for deposit paid and rent paid.

                      Take a stamp paper by paying stamp duty on the security deposit, make sure of the agreement is for more than 1 year get it registered
