        A lady whose son was a very senior banking employee has passed away in covid in India. Her Daughter-in-law stopped contacting since then. The lady stays with her daughter who lives wit her in laws in a joint family. Her daughter has not told her mom about her son (i.e. her brother’s death) as she feared how she would react.

        The lady’s daughter in law sends rs.3000 to her S-I-L for the lady.

        I want to know what are her rights as a mom whose late son has a huge pension and assets while she is sent only a small token and daughter in law doesn’t contact at all.

          Sadly, by the time you’ll get justice she may already have ascended to heaven. This is the reality of India’s legal system so just make sure she (the mother) is comfortable for the time remaining.

                Only spouse is entitled for pension. If a person dies his parents don’t get pension even adult children don’t get pension. However parents and child have right on other assets and insurance claim as per succession act.

                If there’s no specific will, then she is a Class 1 Legal Heir. Meaning all assets of the deceased Son needs to be divided between Mother, Daughter in Law and Kids equally. You can file a suit partition or send a legal notice for the assets to be divided properly.
