        Need help pls. My employer is withholding my salary for April 2025.

        My leave policy states: “Leave: You can take leave due to sickness or personal reasons. The company will continue to
        pay your salary in full during any such absence up to a maximum of 21 (Twenty-one) days
        (based on the Company’s leave policy every financial year) in any financial year; but reserves
        the right to withhold your salary if you continually absent from work for short periods.”

        So in FY 24, i have taken 9 days off, which is from October 2024 till March 2025. (I joined in October 2024)

        In FY 2025, I have taken 11 days off as of now, which is from April 2025.

        They are saying that I have consumed all of my leaves for this financial year and hence 1. I am not allowed to take more leaves, and 2. My salary is on hold.

        What should I do? Am I getting confused with the the financial years? How can I get my salary?

          Lawyer here. They cannot withhold your salary. What is your position, and how much is your salary? Accordingly I can advise you.

            Lawyer here.

            – Policy is clear. You are entitled to take 21 leaves in any financial year.

            – Your company cannot withhold your salary.

                  bro if there is no carry over of annual leaves then you may be eligible only for 2 leaves in april. that means there might be a loss of pay for the rest of the days you took leave for. Also if you took leave without intimating your superior also they may take this action.

                  In any case dont try to pursue this legally. talk within company and try to resolve it.
