April 21, 2025 at 10:09 amWe have a large property in Delhi where my grandfather and his brother used to stay, then my grandfather has 3 sons and his brother had 3 sons, all of them have their respective families.
Since both owners passed away, my father and 5 uncles jointly own the property.
3 of them have moved out including us, and the rest are still residing in this property.We had all agreed to sell the property, but whenever a buyer comes forward any one of the uncles donβt let the sale go through, even after agreeing to sell.
Since all of them are well settled and we are the ones who need the funds from the sale the most, theyβre trying to use this as a leverage to give a lesser share from the sale later in time.
I want to know if my father, alone can sell his share of the property without needing to be signed off by any other parties? If yes whatβs the procedure?
TL;DR
Can a jointly owned property be sold as part unit by a single party without needing to be signed off by the other owners ?
