        Hello legal community,
        I am posting this for a family friend. She lent her cousin 1L for an emergency in 2022. He promised he will return it in 2-3 months. She requested for the money after 6 months for purchasing a 2 wheeler and he did not give. She dropped the idea and again asked for the money last year multiple times, for a medical emergency for her house maintenance etc. After sometime he stopped taking her calls and she kept sending him voice messages, but he refused to respond. She approached him through his sister, every single time he said he will give it in a week, month etc. Now she needs money for her kid’s school admission. She tried to contact him many times, but he never responded. His wife is abroad and earning well…she said she finally contacted her nephew (his son) and broke down and said ‘tell your father that I will commit suicide as I don’t know what else to do…’ and he finally responded with a voice note saying ‘you ruined my son’s exam and mood, go commit suicide as you said…!’ (rough translation of the voice message)

        She was in a bad mental state when she contacted me and I consoled her, promising I will help her to solve this issue. I don’t know what to do, honestly. She is a single mom, she has no other help from anywhere except the small salary from her job. She needs the money in 2 weeks to secure her kid’s admission… Threatening with suicide even though it was out of helplessness and desperation is not acceptable. But the guy told her to commit suicide and he still won’t say when he will return the money.

        What to do? Should we go to police station and file a complaint or consult with a lawyer? Which and all IPC/BNS sections are these? Please help!

            NAL ( not a lawyer )

            police won’t intervene as it is a civil matter. try mediation through mutual family members first. If that doesn’t work, request a cheque. If it bounces, issue a legal notice. a bounced cheque is a criminal offense and typically gets resolved within a year

                She tried mediation through his sister, nothing happened. About the cheque, won’t it talks a long time? She needs the money immediately, like in 2 weeks time.

                Do you have any proof that you given 1L as upi or any other mean?
                Then, send a legal notice
                When it comes to money, always make an agreement paper despite whoever it is (your relatives or others).

                    Yes. She made an online transfer. She has the proof.
                    Is there anything else we can do about the mental agony she is going through?

                    Forget about the mental agony. You have to get a cheque from the person the next time he says – I’ll give it in a week. Ask him to give a cheque with his signature and his future date. If the cheque bounces on that date, initiate cheque bounce proceedings.
