I filed a complaint with the consumer helpline in India against a travel agent who neither provided tickets nor refunded my money, which amounts to around 7 lakhs. After a year and a half of waiting, the agent has now come back with an offer: he will transfer half the amount immediately if I withdraw my complaint. He claims his company is facing financial trouble and has proposed paying the rest in installments. However, he also wants me to sign an agreement stating that I won’t take further legal action.

I’m unsure whether to accept this offer or continue with the complaint. If I reject his proposal, what are the chances of getting my full amount through the consumer helpline? If he fails to pay, what action does the consumer helpline take? Would he be taken to court, and would I need to be present? I am currently in the UK and no longer residing in India.

Would appreciate any advice or insights from those with experience in similar cases. Thanks!

Why should you be the person taking the constraints and being dictated what to do and what not. The moment you come of this forced constraints on your mind, you’ll be able to fight with full might. Give him a lesson, you’ve already raised the step.

Either fight with full strength or don’t at all.

The Consumer Helpline only facilitates amicable resolution between the parties and does not take any legal action. To pursue the matter legally, you will need to file a consumer complaint against the travel agent.

You may execute a power of attorney authorizing someone to sign and act on your behalf in the case. Your advocate and authorized representative can handle the proceedings without requiring your physical presence.

Ok I am confused now so consumer helpline and consumer complaint are two separate entities? What is edaakhil website do?

At moment I am confused whether to take at least half and then pursue legally for other remaining amount.

Consumer helpline and consumer complaint are two distinct concepts. The consumer helpline primarily serves to assist and guide consumers by providing information about their rights and the grievance redressal process. It does not have the authority to resolve disputes or issue legal orders. On the other hand, consumer complaints are formal grievances filed before consumer courts seeking legal remedies.

Regarding the e-Daakhil website, it is no longer operational and has been integrated into the e-Jagriti platform. Consumers can now file and track complaints online through these website. If you have already filed a complaint on the e-Daakhil website and it is pending before a consumer court, there is no cause for concern as the case will proceed as usual. However, if your complaint has not been formally filed, it is advisable to file it immediately.

Whether or not to settle the matter is entirely your decision. However, if you choose to settle, ensure that you have a proper settlement agreement in place.

Thanks for the explanation. I initially raised this issue through the consumer helpline, and it seems they registered it as a grievance. They have been emailing the company, which led the travel agent to contact me.

What are the next steps in this process? Should I also file a formal consumer complaint, and if so, how do I go about it? I’ll also look into the e-Jagriti portal for more information.

First take money because if you withdraw he won’t send any single rupee.

Does anyone now wherether a consumer complain would freeze an account? Travel agent is saying withdraw complain so he can at least transfer half the amount. Is this possible they would freeze an account?
