I recently moved out of a rental property in Bangalore, and my landlord is withholding my security deposit despite multiple requests for its return. Unfortunately, I didn’t have a formal rental agreement, but I do have payment transaction records and screenshots of our communication.

I have been in contact with my landlord, but he has continuously delayed the refund and hasn’t provided any valid reason for withholding it and is not answering my calls neither replying to my messages. It’s been over 3 weeks since I moved out, and I’m left with no deposit, which I believe is being unfairly withheld.

I wanted to ask for advice on the next steps I should take to file a case against him. Specifically:

What legal recourse do I have without a formal agreement?

How can I prove my case using payment records and communication logs?

Would filing a complaint with consumer court or any other authority be helpful?

Any guidance on how to approach this situation or how I can escalate this further?

I would really appreciate any advice or resources regarding the legal process for recovering my deposit.

        Thanks in advance!

          Have you returned the keys?

The process is to never return keys till the final settlement is reached. In your current scenario, if you have paid the money in bank /online transfer then raise a fraud case on your owner so that he will come to senses . If you have paid in cash then forget about the money and move on in life.

thanks for the advice. Since I’ve already moved out of Bangalore, how should I proceed with filing a case? Would a consumer complaint be the right approach, or should I go through a different legal channel? Also, since I don’t have a rental agreement but have online transaction proof, would that be enough to take action?

I think you have to raise a police complaint at the local station, then bring him to the negotiations table.
