I live in a housing society in Hyderabad, and I’m seeking legal advice on how to deal with the harassment we’re facing from the maintenance staff.

When we first moved in, we dealt with two ladies from the maintenance staff. They showed us flats and quoted high prices, demanding brokerage fees. We found a better deal through another broker and paid them instead. This upset the maintenance staff, who felt they’d lost out on the brokerage. Throughout the year, they made life difficult for us.

Recently, our lease ended, and three of my flatmates left. My friend and I wanted to stay, so we asked the owner if we could find new flatmates. She agreed, but the maintenance staff intervened, claiming “replacements are not allowed” and that “co-living” is not permitted. Their reason is that one of the original flatmates was my friend’s sister, and now that she’s left, they’re citing this as an issue.

However, our parents have no problem with our living arrangement, and the owner is also okay with it. In fact, our parents have visited us multiple times without any issues. It’s clear that the maintenance staff is selectively targeting us, as there are other bachelors co-living in the society who came through them.

When potential new flatmates came to visit, security stopped them, citing ridiculous reasons. We questioned the security, hurting their egos. Now, they’re not allowing anyone to visit our flat, including friends and colleagues. They’re making up excuses to target us. Even the owner’s intervention hasn’t helped.

Has anyone else faced similar issues? What legal recourse do we have against the housing society? Any advice would be appreciated.

Fundamental rights stand above by laws

Next time ask them to send a proper written notice , where are the bylaws how it was published etc.

Once they had that just push to cooperative society

Alternatively you can also file criminal case for infringement of your rights with a good lawyer

Other option is to treat her like shit do not open door , do not talk to her and at most she will ask for eviction

Guess what that cannot be done without court orders

What kind of society is this where the maintenance staff is calling the shots?

Exactly! We just don’t want to escalate this further and waste our time on this. But have to find a way to shut their acts

Call and Write a letter to RWA secretary/president and MC. If no resolution received in next 3-4 days, write to registrar of societies serving a copy to rwa president.

Get the owner to involve the society president , treasurer. No point getting your hands dirty. If the owner is being lazy just ask him to initiate the proceedings and follow up with them yourself.

Also try to befriend home owners who are living there.

Unless its not in the bylaws you can call the cops.

Talk to society association and the society cannot deny the right to enter your property to your guests.

If they don’t agree, file a FIR.
