February 26, 2025 at 5:31 amI am posting on behalf of an acquaintance who has found himself in a difficult financial situation due to a series of transactions involving a friend’s associate.Initially, this acquaintance was approached by his brother’s friend, who requested ₹1.5 lakh through his credit card, citing an urgent need. Although hesitant, he agreed after his brother assured him that it was safe to lend the money. The borrower promised to repay the amount within 10 days.
However, just two days later, the borrower requested another ₹1.5 lakh, claiming that without it, he would be unable to return the previous amount. This pattern repeated twice more, bringing the total amount borrowed to ₹6 lakh. Additionally, he convinced my acquaintance’s flatmate to lend him ₹1.5 lakh as well.
One of the transactions failed, and ₹1.5 lakh is currently stuck with the company to which the borrower was transferring the money. The borrower stated that the funds were being used to pay rent for godowns in his hometown and that paying through credit cards provided him with certain concessions. He also mentioned offering a commission in return.
Later, my acquaintance discovered that his own brother had previously lent ₹15 lakh to this same person. The borrower had assured him that if he received additional funds, he would be able to repay the previous amounts. However, it has been 10 months, and no repayment has been made. In fact, my acquaintance’s brother even took out a personal loan to lend this money, hoping to recover it eventually. He did not disclose this situation earlier, fearing that if his brother lent more money, there would be a better chance of recovering the earlier sum.
My acquaintance has not been able to sleep properly for the past 10 days due to extreme stress over whether he will be able to recover his money.
# Available Evidence:
* WhatsApp messages where the borrower acknowledges the debt and promises to return the money.
* A call recording in which the borrower agrees to repay, though no specific amount or deadline is mentioned.# Seeking Advice on:
1. What legal actions can be taken to recover the money?
2. Would the available evidence hold up in a legal dispute?
3. Should this matter be reported to the police, and if so, under what section?
4. Any other practical steps to increase the chances of recovering the amount? My acquaintance is also planning to consult a lawyer but wanted to seek advice here for initial guidance. Any help or suggestions would be greatly appreciated.
