I am facing significant issues, continous harassment, and mental stress due to HDFC Bank’s flawed credit card application process, which enables fraudsters to misuse PAN details and exploit loopholes without any KYC or digital verification. This has led to unauthorized hard inquiries and fraudulent credit applications affecting my CIBIL score and financial credibility.

Despite raising complaints, HDFC Bank has failed to take corrective action. In one instance, they manipulated facts when responding to an RBI Ombudsman complaint, which resulted in the closure of my case without addressing the core issue. The bank continues to fetch CIBIL reports without my consent or any authorization just because someone is trying to apply for a card on my PAN, further perpetuating the problem.

I’ve documented these issues in detail, including a video demonstrating the flaws in their system that allow fraudsters to exploit innocent individuals. Request you to please watch and read my detailed thread or listen to the podcast version of my story.

I can share the links in comment because my post is getting removed for adding links. I am not a spammer!

I am seeking legal advice on holding HDFC Bank accountable for enabling these fraudulent activities, addressing the harm caused, and protecting my financial credibility from further damage.

Any guidance or suggestions would be greatly appreciated.

Lawyer here. If your complaint before banking ombudsman has been dismissed then file appeal before their appellate authority asap. It is important to complete the process provided in ombudsman scheme before approaching courts. If they also dismiss, you can file writ before high court.
Let me know if detailed assistance is required.

Thanks. That helps. Didn’t knew this. It’s been more than 30 days now. But on January 14, I lodged a new complaint against HDFC in RBI Ombudsman for their recurring enquiry, latest done in December 2024. I have stated all the facts in that including the mixing of logs and deceiving RBI. I also mentioned how HDFC evaded detection of flaws and how RBI can follow up and verify the flaws in their system. Let’s see. If still I get similar response, I will reach out to CEPD or you, if needed. Thanks! This is helpful!

Banking ombudsman scheme gives you 45 days from order to file appeal before appellate authority. And 30 days more in case of exigencies. In my experience your second complaint may get dismissed due to them not entertaining new complaints on same grievances (to avoid multiplicity). You should definitely pursue appeal as a better remedy in my opinion.

The complaint previously was closed on November 12 under non-appealable sections by RBI. I lodged new one on January 14, and it’s on new enquiries received in December for which I reached to HDFC first and since they did not gave any answer other than dates, I lodged this new one after 30days. I think it’s more than 45 days now.
I will wait on this complaint since it’s accepted. Given my long list of Ombudsman complain and more facts shared, I hope this one will ensure bank’s accountability. Let’s see. Maybe then I can reach appellate or court.

I’m not sure what advice RBI has given you. Appeal is not maintainable before appellate authority only if order has been passed unnder section 14(a) to (c). Check your order dated 12.11.2024 for it. If any other section is quoted you can file an appeal. I think you have exhausted 70 days, you still have 5 days buffer period left.

Anyway, if you still think it is not an appealable section, then you can still pursue a writ to high court. Which city are you from by the way?

RBI has human bots installed on call support. They have been asked to do certain tasks. All they said non-appealable as no deficiency found on HDFCs end. I will wait for the newer complain before any action. I am from Delhi
