March 24, 2025 at 5:27 pmMy landlord recently transferred ownership of the property Iβm renting to his son. My rent agreement is still in the landlordβs name. I need to undergo police verification for my passport. Should I get a new rent agreement in the sonβs name, or can I continue using the existing one? Will this cause any issues during the verification process?Has anyone faced a similar situation? Any legal insights would be helpful.

The son is currently out of country. And would come back in July. Can he give the power of attorney to his father and make an agreement with me ?-

March 24, 2025 at 5:41 pmIf you can wait till July then great. If not and if the son has already given POA for renting to father then the father can sign the agreement. If not then son will have to get a POA notarised from the Indian embassy and send it to the father.-

March 24, 2025 at 6:06 pmDuring my wife’s passport police verification today the police asked for a rent agreement but she hasn’t submitted a rent agreement as an address proof. She had submitted the passbook copy of a SBI. I want to understand, on what basis the police verification is conducted in terms of address proof when they have the report of the submitted documents. -

March 25, 2025 at 5:55 amYour rent agreement with the original landlord (the father) continues to be valid even after the ownership of the property is transferred to the son. Under Section 109 of the Transfer of Property Act, when a lessor transfers ownership, the transferee (the son) is bound by the existing lease unless there’s an agreement to the contrary. Since the son is okay with continuing the agreement, and you are still in possession, there is no immediate legal need to execute a new agreement until the current one expires.For your passport verification, you do not need to bring this up. If at all it comes up, you can submit a simple NOC from the son and father explaining the ownership transfer and continued tenancy.
