        Hi, back in early 2022 when I was 15 I got my own phone and lent it out to a younger cousin to play on, he himself was 12ish at that time and I had installed Swiggy and zomato on it, he decided to order something as his parents didn’t allow him to order out at that time and age so be spent around 400ish rs on Swiggy and chose the Simpl pay option not knowing what it was without consulting me, I came to know about it when the Swiggy delivery guy called me to ask where my house was so I was a bit confused and I took the order since the delivery guy said it was prepaid and later found out my cousin ordered it, I got a bit worried but after my cousin told me that they didn’t even ask for any verification or any terms of conditions stating that it’s a loan shark app he clicked it, it was a pop up like cash of delivery and no option was given for aadhar or pan details.

        Now ever since that day I have been getting called everyday, well in 2022 they called everyday from 2-3 different phone numbers, then sms and I got texts from random numbers and tried to explain the situation, they said they would forgive the debt and the calls stopped at one point then in 2023 and 2024 I would get a call randomly from them once a month or in an interval of many months, I paid no mind and ignored it but recently they have been sending sms threatening to take FIR action and sending an agent to my house, no calls but just messages, I even got a WhatsApp today stating I have 48 hours to pay or procedure of an FIR will start.

        I just turned 18 last year in 2024 and recently got my pan card, I still don’t have a bank account and never did and I’ll get one in May but do they have any actual legal ground? Like can they actually damage my credit score if I ever get a credit card or even anything legal action against me? I don’t believe so since I was a kid nor did anyone accept any terms or conditions stating I will pay nor did I install their app or create an account.

        I’ve talked to my cousin about it and he plays dumb till date, I tried paying them but they added late charges and since I don’t have a bank account I really don’t have a means from paying them without asking someone else plus I don’t want to pay them since 3 years ago they said they would forgive it.

        If anyone has any experience with this scummy app please do share because it’s really stupid from both sides.

          There is no legal issues here . They made a financial contract with a minor and I don’t think anyone will drag things to court for 400 rs . Ignore there calls or you can loose that number and get a new one.

            Check what is the pending due amount. As this will definitely have an impact on your credit score. So let’s not wait on it to ruin your future chances of securing a loan.

                But isn’t simpl non rbi certified? So it won’t affect my CIBIL record right?

                    I don’t know, check your cibil if this loan is showing in your cibil report.

                    Don’t take unnecessary risk.

                        1. What is the amount they are asking you to pay now ?
                        2. Why did you not pay the 400 on Simpl and close it out in 2022 after eating the order?

                          What is stopping you to pay ₹400 and settle?
                          Why are you shying away to pay for legit order of food that you ordered?
                          From what I know, if you’re willing to pay principal with some minor fine, they’ll be happy to close the account!

                                  Because I didn’t order the thing, I’m vegetarian and my cousin ordered it from KFC nor did I eat it, I tried to return it to Swiggy but the customer support wasnt helpful and maybe don’t make the payment system so anyone can use it without putting any details plus I don’t have a bank account yet nor will I ask my parents, by may I can try to pay it and talk to them about the penalty

                                  They can’t take any Legal actions but Credit score will already be fucked. Good luck taking any loans in the future.

                                    Simpl does not lend to you based on your CIBIL score; supposedly, they have their own method of checking a user’s creditworthiness. Their contact point was the mobile number, which, if you were a minor, could not have been issued in your name. The Simpl loan amount would belong to the owner of the number.
                                    Unless provided, they would not have access to your PAN, so your CIBIL would not be damaged.

                                    Further:

                                    1. Even if the amount was ₹40K, there cannot be an FIR as this is a civil matter.
                                    2. It is possible that after three years of penalties, the amount has ballooned up to thousands, and the case has been forwarded to TPAs, who are just trying to scare you into paying them something.
                                    3. Even in the worst case, if they do go to the courts (which they will not), they will be asked to remove all the penal charges.
