        Sorry about long post.

        My elder brother married his wife 15 years ago, and they have three children: a 12-year-old son and twin toddlers. My parents live in their own house in our hometown, which my father built with his own money, after purchasing the land in my brother’s name when he was 7 years old. However, my sister-in-law has a history of abusing my parents, making false accusations against them, and claiming that they harass her. She also says that my parents don’t take care of her, that they instruct her husband to beat her, and that our family survives on my brother’s money—despite the fact that I earn 10 times what my brother does, and my 68-year-old father still runs a grocery shop for a living.

        My sister-in-law refuses to do any household chores and verbally abuses my entire family. She often visits my parents’ house, where she creates ruckus. On one occasion, she called the police on my brother, accusing him of beating her, leading to an NCR report being registered for both parties. The police did not file an FIR but warned both sides and instructed my brother to live separately and fulfill his marital duties.

        My sister-in-law also called her parents, including her bodybuilder brother and his friends, to threaten us. Despite all this, she shows no respect or care for my brother. We suspect that she may have cheated on him. Her behavior continues to be disruptive, as she regularly harasses my elderly parents whenever she visits their house.

        In addition to this, she demands a share in my parents’ house, even though my brother has made it clear that he doesn’t want anything from them and prefers to stay separately due to her harassment. While my parents have already given them two rooms in the house, she continues to harass us over everything. The situation is complex because, although my brother is the legal owner of the house, my parents live there. Despite this, she still insists on a share in the property and threatens us. Her family—especially her parents and brothers—are not rational individuals with whom we can have a reasonable discussion about property distribution.

        TL;DR: My sister-in-law abuses my parents, makes false accusations, and demands a share of the house, despite my brother wanting nothing from them. She harasses us even after being given two rooms, and her family is unreasonable about the property.

          NAL. Speak with a lawyer.

          Have recordings of your SIL’s harassment of the family. And harassing you for money. Considering your brother is already living separately, ask your father to make your mother owner of the house and say your brother has no share. He can also make you an owner (provided you’re not a son too). He can also make a will to show that your brother has no share. Collect evidence of no Dowry. After that, if your SIL comes with a fake cases- let her. Make her roam courts. Let her waste time. Let your brother file for divorce and if the children are old enough, you can fight for custody on mental issues of SIL. Good luck.

            Ask your brother to give up his rights on the land and your parents to disown your brother, at least on paper. If push comes to shove you can claim your family and brother have no connection and he has given up all the rights on property.

                We are not getting much information from our lawyer, we don’t know law but we have many questions.
                As far as i understand, Legally, my brother is owner of the house, but plot was purchased by dad when brother was 7 years old.
                I have two questions,
                Can my brother give up his ownership of property without consent from his wife and his kids (though his kids are minor as of now)??
                Does his wife have right to claim stakes in my brother’s inherited property??

                    Yes- it is his property. He can do what he wants based on Indian law. But do it before divorce begins so that court doesn’t see it as asset transfer/ hiding.
