No. U broke fd not bank. Fd can be broken in emergency. No penalty no nothing.

Buddy, if that fd was used somewhere, it would have a lien on it. You wouldn’t have been able to break it.

Apologies for my limited knowledge on this, but would the lien be enforced via some instructions input by the linked branch( from the limited information made available, it looks like the FD was created via the branch and not online)?

The branch will get official notice from the concerned department to mark this FD in the name of concerned department.

I think when op was 19 his uncle made an FD in his account and somewhere down the line his uncle got arrested and used that FD as a garentee for bail ( not sure if his uncle is currently out on bail or not) but op accidentally broke that FD . Hence the question

Consult with ur uncles lawyer. If bail was provided with the FD as a guarantee then it could be an issue. But what do I know? I ain’t a lawyer.

                                          NAL

Court keeps original FD receipt as guarantee but these days receipt don’t matter and physical receipt is not linked to any online system to check if it’s still valid and judge isn’t going to check…

For bail you have to submit people who will vouch for you that you will come to court. If you don’t show and and run away, the court fines the person who voucher for you. At the time of filing a bail application the judge wants to see that the voucher has the ability to pay the fine. Hence, the FD.

There are 5 crores cases pending in the Indian court system.

No one gives a flying fuck about an FD from 8 years ago. The judge has already fucked off into retirement earning government pension.

Inform your uncle and his lawyer. Uncle may need to substitute the FD document with some other security else he will be put in jail. This is serious.

                                                    I am a lawyer.

Common sense says simply STFU. Do not speak another word about it with ANYONE. If or when uncle happens to be dragged back into this, do help him with a new bail FD at that time with utmost sincerity.Β

If your uncle is already on bail and is attending court regularly then theres no need to worry..
P.S the judges don’t even check the bail bonds regularly.. they only do if they want take proceedings against the surety for the absence of the accused..
                                                        Rest easy
