UIdk why he did that. He’s got money but i guess month end and stupid decisions as teenagers because shoplifting is apparently “thrilling”. Long story short ; the hyper mart people are trying to extort 10k (he’s still stuck at the mart with them calling his folks).
Either 10k or police FIR it seems.
This is in Bangalore. Is there really a jail time or somwthing for petty theft worth less than 100 rs? Heck less than 50rs. -
IWhy will he pay 10k, ask them to call police. They will slap the hyper mart for wasting their time for such petty theft .

UMe too. Honestly it sucks ass. The way that they gang up on a fucking 20 y/o thinking they cannot do shit. I want to do something about it. They even took the payment in a personal qr. he insisted on making the payment of the said fine to the mart itself but they denied simply. (For obvious reasons)

IOh, do one thing and email the whole incident to the mart higher authorities . Good thing he did was paid via QR. send all screenshots.
Also never do same mistake again.
How do they came to know he has shoplifted ?

USo they were keeping an eye on us because we were basically spraying room freshners (in a close proximity making sure nobody else gets disturbed) since then they kept a track of all our activities. They even told whatever we did. I feel like this is a crime too like we were not guilty by that time why stalking random kids ??

IThey did a good job.
Why the hell would you spray room freshner ?. Only spray them if they are labelled as tester.
Take a lesson and don’t vandalise things like that.

UHonestly, there were some of the freshers which looked like they were all used for testers so we did not think much.

ULaw does not concern itself with triffles. Kindly read section 95 of the IPC.
For your convenience, i’ll copy paste the provision here-
*Section 95:- Act causing slight harm –
Nothing is an offence by reason that it causes, or that it is intended to cause, or that it is known to be likely to cause, any harm, if that harm is so slight that no person of ordinary sense and temper would complain of such harm.*This defence can be used when the harm caused is so slight that no reasonable person would file a complaint for it. No reasonable person will file a complaint for Rs 35. Even if they do, it will be dismissed.
They also cannot extort money from your friend by dishonestly putting him under the fear of prosecution (Section 383 IPC). Extortion is an offence punishible with 3 years of imprisonment or fine or both.

UThats extortion. They may spin it as settlement but the settlement must be balanced with the crime. 10000 or even 5000 as settlement for a 35 rs theft is not viable but since your brother already settled nothing can be done.
For next time(since this seems psychological), tell him to let the police come he might have to either spend a night in jail or might just be let go.
A new law is also coming for doing community service for petty crimes like theft of under 5000

F20 year old are not teenagers. What the fuck are you smoking? If you are stealing pens and spraying fragrance in stores at 20 year old then you are scums and losers that deserve to be behind bars and get special treatment from the cops.
You are lucky they didn’t file an FIR, once you have an FIR you will have it forever on your visa application and get denied entry in all good countries.
