April 12, 2025 at 11:55 pmI’m living in a society in Mumbai. Owner wants to do only a yearly agreement. Society is charging me 5k to everytime I renew the rent agreement. Doing it for the 3rd time now. I don’t think this is legal but they say they have passed this in their society meeting so we have to oblige. Now this time around, while renewing the agreement, they are also asking me submit the aadhar card along with photos of all the members living with me which I already did 3 years back when I entered into the agreement first time. Owner and broker just wants me submit the documents and get on it. But something does not sit right with me this. Why do I need to submit the documents again? It is a nightmare for people living in Mumbai on rentals. Not only you have to pay rent that is very high, you also have to pay brokerage everytime you renew the agreement. Please provide me suggestion on what should I do. Should I submit the documents and get on with my life or deny it and contest the society charges and documents submission in court? -

April 13, 2025 at 12:05 amIt is entirely up to you, but for most people , it would not be worth the hassle. The owner has no obligation to continue to rent to you. So, if you are unwilling to follow the society process, he could decide not to enter into a new agreement with you.-

Or is it not possible for him to find another tenant who is willing to follow the society process ?The reason rents are high in most parts of Mumbai is because demand is strong relative to supply. It is basic economics.
Sure, a landlord would prefer to keep an existing good tenant, but they would probably not go to court against the society management if they can easily find another one.

It is very annoying. I don’t live in India so cannot argue back to much-

I think the situation is a bit dire with tenants not invested in the building and the society has to manage the block.-

Buddy people here don’t have basic knowledge they just age, marry and reproduce. They can’t see anyone growing, it’s beneath them…-

Nor do me or my lawyers have time to deal with this personally. Also alibaug se aya hai kya is an expression for the person, not on me.

They charge nominal 600 or so in total and come home with laptop and do all the rent agreement filling procedure online on the maharashtra gobt portal. They take fingerprints through sensors and verify aadhaar.U dont need brokers after the first time ever. That is a scam.

April 13, 2025 at 5:42 amIn delhi I’ve never seen anyone pay brokerage again… You just take the old agreement and type a new one with the same language but different dates and amount and use that.… Here the norm is 11 months agreement… If a rent agreement is less than 12 months you don’t have to get it registered…. So you just make it for 11 months on a stamp paper, get it notarised for 50 rs and be done with it.
Once the broker asked me to pay brokerage for the second year, i just laughed and put down the phone…

April 13, 2025 at 9:07 amIt’s the understanding between you and the owner. If there’s no understanding and you’re dealing with a broker, leave. I only ever paid the broker when I first moved in. After that, I just extended on email, and the owner was fine with it. I never had to pay anything to the society, that’s upto the owner to deal with the society. Also request AGM details from society for these charges and tell the owner that you are gonna bear these charges if applicable as he’s the one not agreeing for a 3 yr contract. If nothing is happening, leave, no sense staying in a society like that.

April 16, 2025 at 5:41 amNo owner should EVER agree to this – having a tenant without proper tenancy agreement. Indian laws are very tenant friendly and in case you have a bad tenant without an agreement it takes YEARS to evict by due legal proceedings.-

The people living in the society are jealous of the extra income of the society member who is renting and try to slap extra charges which obviously they cannot take but would put it in the society fund for their use.In one of my friends building, each time a person who rents moves in, needs to pay damage charges of 5K to use the lift and stairs for moving the stuff.

They think they are doing a favour to humanity by renting their home to someone else.I’ve lived in flats all my life as an owner and have seen the mentality of such owners. Even the society groups are different for owners and tenants and tenants are never involved in any celebrations or general complaints etc.

April 13, 2025 at 8:52 amFor the events and celebrations, owners are given free tickets but they tenants need to pay money to celebrate the events. Even though the owners pay the same maintenance charges as someone who has not rented the house, tenants have to pay additional charges.

April 13, 2025 at 10:38 amWhy is the broker still involved?Talk to the owner, you know him well at this point. Tell him either bear / split these costs or keep it between him & you. No broker, no society. Or atleast remove the broker. You can get your agreement for 500-800 on nobroker.com – they get it attested & registered as well.
If he disagrees, look for another apartment within the society. It will be easier than pursuing this legally.
Also if all of this is mentioned in the society bylaws, then you’ll need to challenge the society bylaws in court. Most likely if the bylaws are already registered with the municipality then their chances of winning is high. They’ll just say it’s the fees for mygate + amenities.
But as far as I know – mygate charges for total number of user accounts. Which has already been created when you originally came here.
Alternative to all this – register just 1 person from the house. Use the same mygate app for everyone. Everyone in the house can log in with your phone number. I’m doing that rn. 1 account can have 3 people. And also, don’t update mygate app, if they release an update which doesn’t allow multiple logins then you won’t be able to use this
