I live in a rented house in a society and to take care of our 18 months daughter, my wife quit her HR job in October 2024. I suggested her to start a baby day care business from home, for better future savings. Home based day care business is very common here, in the locality where I live. My landlord has no issues in us starting this business, but when I requested society to provide me NOC, they denied. Can the society legally deny my NOC request?

          Makes sense. It’s illegal.

Society is bound by society rules. I don’t think it is that easy to run a small business from a flat/house. Doesn’t matter own or rented.Β

Your own should not agree. That is against the agreement

Depends on what your landlord has signed as society bylaws. Some allow, some don’t and some need additional info.

The landlord would have agreed to abide by the society bylaws. What he allows you do do, is irrelevant if it’s against the society bylaws, which he is bound to follow.

You can check if the by laws prevent commercial activity. However, the society can irrespective deny your request.

Most of the society don’t allow home business like tuition, catering, day care….
