RHi everyone, I need some legal advice regarding an issue happening in my housing society.
On the ground floor of our building, there are about 4–5 garages, originally open from the sides. Over the years, some of the previous committee members and current residents have made modifications to their garages — such as elevating a part of the garage by cementing it or even fully constructing rooms within their garage space.
Because of these modifications, my own garage has been partially barricaded — one side was cemented by others, and the other side now has a fully constructed room built by a neighbor. Due to this, I have faced major difficulties using my garage properly. I couldn’t park my car there, and even when I tried renting it out, tenants refused because they couldn’t properly get their cars inside. Eventually, I had to buy another garage.
Now, since we cannot use the garage for parking, we decided to also cement the remaining open part and convert it into storage (similar to what others have done). However, some society members are now objecting, saying it is illegal to barricade or close the garage space. They are even threatening to involve the municipal councillor and break the construction if we proceed.
This feels very unfair because:
• Other residents have already modified their garages without objection.
• Due to their construction, my garage has become unusable.
• The society stayed silent when others made modifications but is now selectively objecting when I try to modify my own garage.I want to understand:
• What are my legal rights in this situation? Can i not cement it even if it is my personal property? They are saying if i cement, it will stop other cars from turning their vehicles to exit but that is not true. Our parking does not come in anyone’s way of movement. They just want us to not barricade it so they can have ease of turning their vehicles.• Can the society selectively stop me after allowing others?
• What remedies do I have if they harass me legally? One man has good connection with the local councillor.
Any advice on the best way to move forward would be highly appreciated. Thank you!
