January 20, 2025 at 6:29 pmI was at the red signal waiting for it to turn green (stationary for a while). Suddenly from behind a car went alongside my car scratching and denting the doors and ran away breaking the signal.Luckily, I focussed on noting down the number plate, time of incident and there were traffic cameras at the signal.
I have OD insurance and TP insurance coverage.
I went straight to the police station and gave a written statement. He told us that the case would proceed to court if I file an FIR. I went back just submitting the necessary details in written statement for investigation. However, I plan to visit them tomorrow again and file an FIR.
What should the steps for insurance claim ?
What are the chances of the opposite party showing up as he just kept declining the calls the police made ?
Can I get the opposite party cover my damage in their insurance ? -

rather file an FIR get FIR copy and submit it to your insurance for a claim and that way the insurance company will take money from the culprit’s TP cover and not yours.Don’t get scared from police people saying you this is a hassle and will take and stuff.
As soon as the other party hears there’s a case, there is a strong chance they will settle this outside court and give you repair money,
which is what you want right?

January 21, 2025 at 6:45 amThe opposite party cannot cover your damage in their insurance unless there is an order by motor vehicles claims tribunal or some other court. This is how third party damages work. Sue them and then claim. But the legal costs are usually not reimbursed or capped at some paltry amount.
