Tenant filed Suit for Perpectual Injunction stating that I demanded to increase rent and security deposit. None of that is true and the tenant was supposed to leave by April end. He orally agreed that he will vacate by April end and on May 5th sent me a message that he filed a case which left me utterly shocked. He also lied that I sent henchmen to harass him.

I’ve rental agreements and proof that he agreed to leave the premises mutually.

Every lawyer stating that this is going to take atleast 1 year or even more.

I live in Canada and this property is in Hyderabad.

Should i travel to India? How do I deal with this to evict him asap?

        Any legal advice?

family member facing similar situation. Tenant filed against owner. Owner countered. Almost a year. Tenant not appearing sometimes. Judge goes on holiday sometimes. I can sense our lawyer is pocketing money. It’s just dragging. Tenants rot when they live.

Lawyer here. No need to panic. Just hire a lawyer and defend the suit filed by him. You don’t have to travel to India for this purpose. Furthermore, if the agreement ended in April then you can file an eviction suit against him.

Agreement ended last year. He needed time to vacate so i gave him 3 months until march and he requested time again so gave him another month of april.
Can i file a counter case?
Can I cut his electricity access?
In your experience how long can he drag this case ?

I am extremely worried and don’t know what to do else rely on lawyers.

                Thank you for your advice!!

Technically you cannot do much. As I mentioned earlier you will have to file an eviction suit against your tenant. Its a long drawn process but no other option. Get in touch with me, lets find a way out of this.

He saying he filed a case doesnt mean anything.

                  Get him to vacate asap.
