        Hi,

        I wanted to seek this subโ€™s esteemed opinion: the paternal side of my family consists of an elder brother (say P), his younger brother (say Q), and their 96 year old mother (say S).

        Q has a really troublesome family life and his wife is a difficult person. Since S was growing old and his wife refused to take care of her, he asked P to move into his (Qโ€™s) house a decade ago to look after their mother S. No rental agreement or document was signed but P and his family did get govt documents (passport, bank statements etc) made for this address as they started living.

        Q himself is not a good person and took advantage of this setting and Pโ€™s financial dependency (since they work together) to trouble Pโ€™s family time and time again. Now Q wants P and his family to vacate his house. And he has sent a document that notes that he has โ€˜waivedโ€™ all rent till date, and he will charge an arbitrarily high amount (2 lacs a month) for a stay exceeding March. This is not a legal notice but just an excel sheet which has family cash balances. Q has also claimed P withdrew huge chunks of cash from the family account that P denies.

        I am Pโ€™s son and Iโ€™m worried for my family because I do not live in India. What are the points favouring my father and I against Q and what should we be vary of? We intend to leave the house in any case but not without sufficient notice. What are our possible options from being strongarmed by Q?

        PS- Q is a bully who is trying to get me involved because he thinks he can intimidate me.

        Iโ€™ll be really grateful for your advice.

          Iโ€™m not a lawyer, but I recently got to know that, if there is no signed agreement, then itโ€™s not illegal.

          Court does not accept emails or self prepared excel files as evidence/proof.

          But for more details you might want to connect with a litigator.

                Sorry forgot to mention this. Itโ€™s in Maharashtra, the house is in Mumbai suburbs
