HI, I booked a honeymoon trip to Manali from a local tours and travels vendor for 60K. he never sent any booking details even asking repeatedly. At last minute he cancelled the trip saying there is heavy snow. We asked him for refund he said he will. Now he is not picking calls nor replying to messages, its been 1 month. What can i do legally to get the money back?. My friends say for 60k its not worth the hassle to go to court, police and have a lawyer to get the money back as legal fees will become more than this. Is there anything i can do to get my hard earned money back. Is it that simple for someone to cheat and live freely in this country :'(

If it’s tour guy with a shop he must be registered, go to consumer court. Low litigation costs also you will might get compensated for the small costs your bear

Never pay such huge amount in advance. If he insists it’s most likely a scam. I never pay more than 10% until I’m actually at the location.

Good luck for the next trip man. Money is fine but he ruined your honeymoon. That’s unacceptable

It seems your friend might have been involved in this. I strongly recommend reconsidering how much you trust them.
If you have made a UPI transfer, report this as a case of cyber fraud to the cyber cell immediately. They can help freeze the account in question.

Can this be considered as cyber fraud as i sent the amount knowingly. I mean it was with my permission?

Most cyber fraud occurs when victims willingly transfer money to scammers. In this case, they offered you a service but failed to deliver it, and since the transaction was conducted online (via UPI), it is certainly actionable.

                                    Do this
Go to your bank and raise a dispute and you can file a cyber crime report stating services for paid amount not received. It will block his account and put a lien on him and you can then pursue cyber crime police for further investigation.

Befare engaging any tour operator or any vendor, always read their online reviews. If they dont have any reviews or just a few reviews, run away from such providers. Always choose someone who has lots of reviews for an extended period of time.

Secondly, always pay just a small advance amount for booking purposes, but never the full amount. The balance is always paid in person when you get the service. The exception is if it is via some well known providers like TripAdvisor or Make my trip

consult a lawyer and ask him to send a legal notice (choose a lawyer with best prices)

Go to the cops, bribe them 10K, they’ll get your money.

Take someone local, if there’s someone you know that has contacts at the station, nothing like it.
