ESo we are Puja samagri business and had domain registration since 5 years but we started business like 1.5 years ago and at the same time we stated with trademark process.
At the last moment some other brand opposed our brand and registration now stuck midway. It has been now 9 months but case is till pending with Government.
You guys won’t believe but it seems totally unethical to oppose our brand.
For example,
We are in Puja Samagri business from Maharashtra and brand name is ‘SEEMASA’ where as other party is from other state and have different products and their brand name is ‘SIMA’.
They have said that similar brand name can create confusion among customer but I do not understand how they can appose our brand because name is totally different, mode of operation is different, Logo is different, target market is different, products are different.
What can be done to speed up the decision?

BLawyer here. Where are you based ? How many hearings have been concluded yet ? Have you filed evidence before the Registrar ?

UTill which stage have the Opposition proceedings taken place ?, for ref this are the steps:
1) Notice of Opposition(Filed by the Opponent/s)
2) Counter statement(Filed by the Applicant)
3) Rule 45(Filed by the Opponent/s)
4) Rule 46(Filed by the Applicant)
5) Rule 47(Filed by the Opponent/s)After which the matter is taken up for hearing/s.
This usually takes about 1.5 to 2yrs give or take.
