April 29, 2025 at 6:09 pm**Not looking for legal advice, just want to learn how this case will stand out in court**I came across a post which shows an accident that occurred on Monday in Mumbai where two young girls are seen overtaking a truck from the left side on a narrow road when they slip and fall and one of the girls (pillion rider) gets run over by the truck and dies.
The article also mentions that the girl that was riding did not have a driving license. Now despite there being a very clear CCTV footage of the entire incident, the truck driver has apparently been arrested and booked under multiple sections of the BNS including 106(1) (causing death by negligence), section 281 ( Rash driving), section 125(1) (endangering human life) and also sections 3 and 134(a)(b) of the Motor Vehicles Act.
Any person of sound mind will know upon seeing the cctv footage that’s there was literally 0 faults by the truck driver and infact many laws and rules broken by the two girls on the scooter.
How is it possible for the truck driver to be arrested even though there’s evidence that puts him in the clear? As a lawyer representing the victim what even can you say to accuse the driver?
It’s very unfortunate and unfair that the poor driver now has to go through months if not years worth of pain for something that isn’t even his fault.

April 29, 2025 at 6:32 pmI am not a lawyer. And I’ll let the professionals give you a complete opinion about the validity of all the charges against him.But this was likely a retaliation (although wrong), because the driver did not stop to help the victim, he fled and then switched off his phone.
The arrests were made following a complaint. So it’s most likely a lot of people got involved, and the arrest was made.
The CCTV footage must’ve surfaced much later. (As is the case in most cases)

April 29, 2025 at 6:48 pmIf there’s no fault of the truck driver, he’s arrested only for 2 things:1. Publicity for police, whitewashing image.
2. To extort money from the driver.
