Hello everyone, so I am from pune and I was working with a Pune based startup initially as an intern but was later joined full time. During my time as an intern there were always an issue of getting my stipend but i thought that becoz i was an intern they don’t take things thats seriously but this issue of payment still continued when I joined as a full time employee first month passed and we didn’t received our first salary and we questioned the organization but the reply was it will be credited soon but it didn’t happen this thing continued for straight 3 month and the reply was same finally when it was really frustrating we agrued about the payment and got our first salary and when asked about the other one they requested to wait for a few days but again it was the same things and it continued I worked around 6 month but only received 1 month salary and then I left the company as they were not paying no matter how much we requested now also some of the stipend is still pending I want some legal advice on how can i recover my salary as they are not responding on calls or mails
I have worked with the company as I was a fresher and thought there was genuinely some issue but didn’t expected this, Most of the employees have left the company with the same issue some are still working in the hope of getting some part of the salary
I have thought about filing a legal case on them but not sure how strong our Indian labour law is and is there any chance of me getting my salary

          1. You can send the legal notice by stating all the facts to the company and you can complain to the ICC of the companies

          2. After that you can complain to the labour commissioner
          & Registrar of companies

Its unfortunate to be in such situation and its expected in startups based on their funding and expenses. Its time to team up together and hire a legal advisor to help you all. Do u have any mail or phone or message recordings in this context?

I don’t think so, they have never replied to mail or message and even when I was leaving I specifically asked for a formal mail regarding the dues but still didn’t receive one and tried to reach them out but no reply

Its time to send a Legal notice to ensure they respond. Else things will take a turn based on how strong the opponent is in Legal and financial aspects.

Send a legal notice to the company through a lawyer, demanding your unpaid salary within a specific timeframe. If they donโ€™t respond, file a complaint with the Labour Commissionerโ€™s Office in Pune. Labour laws protect employees in such cases, and a joint complaint with ex-colleagues can strengthen your case. Keep all evidence intact, like offer letters, emails, or messages, and consult a labour lawyer for guidance.

Similar case here in gurgaon, but I won’t go in specifics . Feel even dumber now, not that valuable of a company to learn from n also wasted my time , without pay. It just sucks …… Now I’m still a fresher with near to zero valuable experience. So I thought of just not mention that company to anyone in future…

Yesterday I had interview for MSIL. I was confident on my projects n my basic knowledge, but the interviewer was just stuck on what I did in my company, my exact role. And after mentioning few he said, okay so u did this only( referring how low/ bogus). I was so disgusted by his judging looks. Man the role is for fresher right so ask technical questions, move over to my projects n my knowledge. Bitch ass was just toying with me and that unprofessional HR sitting beside him was just smirking n having pakoras mid interview, i was more disheartened that feeling bad about the interview. I have decided never to mention anything over plain 6 months of intern in my 8th sem. I’ll fckin remove any trace of my current company from my cv n linked in. I hate them so much. Why ruined some freshers important year if u know u have a shitass company. Dude they didn’t even had my department I was only intern with no senior of my department. Whatever I learned or did was by myself n learned all by myself. But I know I am the one who is to blame. I kinda fell into comfortzone, kept telling my own stupid ass that I’m still in college, or now just passout no need to change unless necessary. Fuck me man.

I can feel you man, once you get into that comfort zone you just feel like staying there, my friends who were with me have learned so much in the course of time and here I feel really lost. Ik that you don’t want to mention that company name but unless you have a pretty good reason for the 6 months gap it’s ok but if not you better have some good industry based certification. These interviews we give will be just like this from now on and the Hr I don’t think they know about your field anyways… You talked about being the only one in your department ik how frustrated you feel when you have to learn everything by yourself when you are not even sure that if you are going in the right direction or not even I didn’t have any seniors who know about my field or I can ask for any help I was in the same situation as you
                                      It was a nightmare
I hope you find better opportunities from now on and all the best for everything forward
                                      You can do it man
