        One of my close family members (M) has been named in a murder FIR. The incident appears to be related to a property dispute in which one person was killed. Despite not being present at the crime scene, the victim’s family has falsely named M in the FIR. This can be proven through multiple CCTV footages. The police are currently searching for M and are regularly harassing his family.

        The case has been registered under BNS Sections 103(1), 109, 115(2), and 118.

        What should our next steps be? Please help

          File quashing of FIR before the High Court.
          If the court finds the evidence sufficient, the FIR can be quashed against M.

            Get a Lawyer and consult many more instead of asking questions on Reddit

                Sir we have already hired a lawyer and he has filed an anticipatory bail plea in the district court.
                Afaik this is a legal advice sub so I just wanted a second opinion or any other options available with us.

                First of all…
                file for anticipatory bail in sessions court…
                second… file for quashing of FIR
                The quashing of FIR is rarely done but it’s possible if there is no evidence in the chargesheet based on the charges in FIR.

                Your evidence would not be looked into until the trial starts…

                  Hi. Delhi based lawyer here. File for anticipatory bail asap and file a quashing petition too. The chances of the latter getting quashed are bleak, but no reason to not take pro active steps if the said accused person isn’t involved.
