April 9, 2025 at 5:04 pmA few years ago, due to some financial problems, my family decided to **give our ground floor on lease** to a man who already lived on the **2nd and 3rd floors** of our building. We had known him for **4–5 years**, and he always behaved nicely with us. We thought of him as a friend. Because of that trust, we made a terrible mistake — we didn’t doubt his intentions. He gave us around **₹3–4 lakhs**, and the **market value of the floor is ₹12–14 lakhs**, confirmed by a property dealer. My **mother is the owner** of the floor, and when my **father was out of town**, he took my mom to sign some papers. She isn’t highly educated and didn’t understand legal terms, but because we **trusted him blindly**, she signed. Later, he also took my father’s signature — again, without reading the paper carefully. We all assumed it was just a **3-year lease**.
Now, when the **3 years ended**, he suddenly showed up and claimed that we “sold” the floor to him, and now he wants to do the **registry**. He says his lawyer read the paper aloud to my mom (he didn’t). My mom clearly remembers — he **just told her where to sign**. Later, he **transferred ₹1 lakh** into her account without our knowledge or agreement, and started claiming that we sold it and have to register it now.
We refused — and now he’s **blocking our way to the rooftop**, acting like he owns the whole building. He already owns the **4th floor**, which we were sadly forced to sell earlier due to business losses. But now he’s trying to **illegally grab** our ground floor too.
We filed an **FIR**, and initially the police were okay with us. But slowly they started behaving rudely, and instead of helping the victims (us), they began **talking like we should just “settle”** the matter by taking **₹1 lakh more** — as if this is a normal deal. Like seriously? A **₹14 lakh property for 5–6 lakhs total**? Is this how justice works?
👉 **The real question is:**
**If this was truly a sale, why did he wait silently for 3 years to ask for registration?**
No real buyer does that. He waited because he knew it was a **lease**, and now he’s trying to **flip it into a sale by cheating**.We trusted the wrong person. Yes, we didn’t read the papers properly. But that doesn’t mean someone gets to scam us, and the police **stand with him instead of protecting us**.
To anyone reading this: **never sign anything without fully understanding it**, and don’t trust someone just because they act sweet.
And to the system that’s supposed to protect victims — **do your damn job.****Plz suggest us what should i do i am just 18 and these mfs f****** my mind and my parents also suffering because of this we do not have any family support that much maybe beacuse we are not rich and plz one more thing like how that man not letting us to go on roof but in when we sell our 4th foor there is not any condition in agreement that 4th floor owner have all right on roof ???????? plz suggest soem tips and delhi police is amazing like you surely heard by someone how indian police greedy for monry right i also heard that thing but never belive that no only in films this happen but when i see all this irl f u delhi police ik not every one but some people**

April 10, 2025 at 1:50 amNot a lawyer.Out of curiosity – how does it work if a party does a distress sale at slightly below market and after a few years disputes the sale claiming that they did not know it was a sale agreement?

April 10, 2025 at 9:26 amNot a lawyer but to sell a property, you have to go to some government office right? Just taking a sign won’t do.Please correct me if I’m wrong.

April 11, 2025 at 2:38 amAfter getting the sale deed registered at a government office, the sale is completed. Before that it is just a document that can be canceled anytime by either party.-

April 10, 2025 at 6:15 amNALBut I think the guy made your people sign an agreement to sell and transferred the advance to your account. There is no easy way to get out of it. It is now a long legal battle for like 5-10 years. You have 2 options now. Either you actually settle for an amount lower the fair market value or fight the legal battle which will need time and money.
But if you can afford to spend the money and time it is better to fight because by the time you get through with this case the property will be of a much higher value as well.

April 11, 2025 at 8:36 pmNAL. It was a sale agreement, not a registered agreement you know that. Either party can cancel it anytime. Hire a good lawyer. Don’t consider your case as weak, you can easily get justice if you fight for your rights. -

April 12, 2025 at 6:23 pmNAL-**1. No, you didn’t sell your property – it’s a lease, not a sale!**
That’s a classic trick. He’s trying to make it look like you sold him the ground floor, but this is a **lease agreement**, not a sale contract. The fact that he’s waiting three years to ask for the registry proves he knew it wasn’t a sale. If it was a sale, he’d have been pushing for paperwork immediately. He’s only coming up with this now because he’s trying to turn the lease into a sale by manipulating the situation. **That’s fraud.****2. You need to take control and not back down.**
I get it; the situation with the police is frustrating, but don’t lose your cool just yet. The police may be **greedy**, but you can still fight back. Get a **good lawyer** who’s willing to stand by you, especially one who deals with property disputes. If the police aren’t helping, **file a formal complaint against them** with the **Delhi Police Complaints Authority** or even approach the **National Human Rights Commission** for negligence or abuse of power. You can’t let this slide, and they can’t just brush you off.**3. The police “settling” for ₹1 lakh is a joke.**
No, you’re not going to settle for a fraction of your property’s value. ₹1 lakh is peanuts compared to ₹14 lakh. If the police are pressuring you for a bribe or to settle this way, report it. There’s no way you should be forced into accepting a bribe deal for your property. **Demand full justice.****4. Rights to the rooftop and the 4th floor issue.**
Legally, there’s no automatic right of ownership to the roof just because someone owns the 4th floor unless it’s clearly stated in the agreement. If nothing was mentioned in the sale or lease agreement for the 4th floor regarding the roof, then your right to access the roof is **untouched**. You can go to the local municipal authority to clarify the **ownership of the roof**.**5. What should you do now?**
First, get a copy of the agreement you signed (the one your mother signed). Even though you didn’t fully understand it, you can still use it. **Get a lawyer** to go through the document, especially focusing on the terms that are being misinterpreted by him. If it’s a lease, then **he’s overstepping.**
Secondly, if the police continue to be unhelpful, **escalate** this case to a senior officer. You could also try approaching the **District Magistrate** for intervention if the police are refusing to help.**6. General tips going forward:**
– **Learn from this mistake** and make sure to understand everything before signing anything in the future. Don’t trust people blindly just because they act “nice.”
– Don’t let this guy bully you or your family. **Stand firm.** You have legal rights.
– It’s easy to feel overwhelmed, but keep pressing for justice. Your voice matters.Lastly, I know you’re frustrated with the police. It’s no secret that corruption exists, but not all cops are bad. Keep the pressure on them, and don’t let this turn into a deal with “₹1 lakh.” Fight for what’s rightfully yours.
Don’t back down. Fight for your home.
