POur family owns 50,000 sq mt of Forest Land which has not been acquired by the forest department YET!
The surrounding 13 lakh sq mt of land (Now a prominent wildlife sanctuary) was our ancestral land and we were forced to sell at ₹13 per sq mt to the Forest Department.
We still have 50,000 sqmt under our family name but it’s located in the dense forest (wildlife) with no human entry.
What should be our next step? To acquire a land for land deal with the govt? Or to settle for compensation.
Any legal advice would be truly appreciated. Thank you so much in advance

PIt is a very difficult topic.pls take following suggested measuresand put it together in a file:
1. Govt notification of acquisition clearly demarcating boundaries of acquisition. If necessary apply under RTI and get the information.This should be available with DFO.
2. Request for a drone survey and try and find out if satellite mapping can be done for area which you claim still to be under your ownership.
3. Find our what you are free to do with the land which is under ur control .get this in writing or request for notification denitifying this area.
4. If you plan to do something with this land seek explicit permission. If not forthcoming, send a legal notice under Sec 80 CPC through your lawyer and go to HC under writ.

LWell the first sentence of your post is incorrect to begin with. You can’t own forest land. Besides- the forest department won’t come to acquire something they already own.

PIt’s ancestral property. The govt had already acquired 13lakh sq mt of land from us and was declared a wildlife sanctuary, the last case hearing was in 2005. The above mentioned 50,000 sqmt of land is yet to be acquired and they had overlooked this.

LEven though its ancestral property, if it’s on a notified forest law- it is the forest department’s land. Sorry to say but that’s the law. For obvious reasons ofcourse. The case might just drag on for years – but you won’t be able to do much about it. They will be coming for it. If not now then soon.
