        My dad bought a land from this guy, whose brothers ordered a stay notice due to their own inheritance issues. It is the only property we own and has been caught up under a stay notice. What should be the course of action ?

          You have to wait and watch until the case is closed or wait for next court hearing/orders

                  They don’t use that land, its currently empty and we are the rightful owners with all the necessary papers.

                      Are you in physical possession of the land. By which I mean do you have a compound wall or a barbed wire around it with a board prominently placed on the land declaring your ownership?

                      If not, see if you can do it. If you can do it, then click a picture under the board. That’s the evidence you have possession of the property.

                      In courts, possession makes a huge difference.

                    Ensure possession of land. Build a boundary wall. If possible, have a security guard. Put up a large notice that you are the rightful owner of this property. Let the other party come and cry that it is disputed

                        We have tried to build boundary wall and they come create so much drama… its crazy. I’ll ask my dad to try again, its possible to build a boundary wall under a stay notice tho ?

                        Were you made a party to the court proceedings? Stay cannot be granted against you in any case without making you a party to it.

                        You should consider challenging it.

                            Yes we have challenged the stay order and have taken the same action as them, but they are farmers, they’re allowed to use their land, meanwhile, my dad who finally bought a land from his life savings wanted to build a small house and a garden there, which apparently is not possible with a stay order

                            I believe this practice is rampant in villages one party sells the land and other family members want to be paid too see if you can reach a compromise under courts suoervision

                              You have to maintain status quo.

                              Immediately file an application for revocation of stay.
