What if I genuinely want to take up a lower pay salary ?In my case, after the breakdown of my marriage, I may not feel like marrying again and may want to take up a lighter job with very less load to take up spiritual practices and focus on my mental health. A breakdown of marriage might make me feel there’s absolutely no purpose in running in the rat race and I might just want to work for 4-5 hours daily to just get by my daily expenses.
Can I be forced to give alimony based on my previous incomes ? Let’s say my wife earned 8 lpa and I earned 25 lpa. Then, maybe due to marriage breakdown, I take up a job of 5-6 lpa. What would happen in that scenario ?

May 5, 2025 at 5:00 pmYeah. You will show that as salary slip in your affidavit (the lower salary) wife will inform the court of previous ones. Alimony awarded will be a balance between the two. -

May 5, 2025 at 5:15 pmCourt will take the duration when you two married.This is very old trick used by husbands to pay less alimony and give less maintenance. Court deals with this kind of scam day in and day out.
So be prepared for high scrutiny. Also, remember your wife’s lawyer is going to be sharp too and will be very persistent in showing the court that what you did was a scam to pay less alimony/money

May 5, 2025 at 4:59 pmHi. I’m a Delhi based lawyer. You may cut down on your working hours and consequently your income with the best of intentions, but be sure that it’ll be viewed by the court with utmost scrutiny. The court will analyse the reasons for decrease in income and why the same was opted for, and it’s usually approved only when it’s a result of circumstances beyond one’s control such as health issues etc. If it looks like a deliberate attempt to avoid alimony, it won’t reduce the alimony amount. It’s totally upto the Court’s discretion.-

I sounds like I don’t even have control over my life, that even if I want to live to minimalist life I can’t even when wife could be earning decent.And what if I left my high paying job even before divorce was filed ? In that case can’t I say in that court that the reason for divorce itself is because I wanted something with a lower work load which my wife didn’t support ?
