SToday my brother & I was celebrating Holi at my mama’s place my younger brother was standing outside not troubling anyone there and I was inside house.
Some people came started playing Holi throwing splash (with dolchi like a mug using which they throw strong splash of water) on brother face repeatedly and my brother told them not to do so but they kept doing it . When it got too much my brother and those people got into argument . As these people were drunk they did not listen keep arguing and when they started to charge on my brother.
I ran to save my brother and then again one of them throw a strong splash of Water on my face . I said chutiya then all these drunk started charging on me and one of them hit me with a fight ( iron tool wore in figures ) on my eye .They all charged on me ans my brother.
Now I want to file case against these people but my family is saying don’t do it because I will have to go to court and lawyer fees and those people might hurt again.
What should I do file case or listen to my family members 🤔. Please help me

HDo you have any way of proving that they hit you using the tool (witnesses or video). If yes, then go and file the police case. Lawyer and litigation costs do not apply in criminal cases if you are the victim / informant, as case is in the name of the state and the public prosecutor will be the one to represent the state in court.

HYou will need to get the police to register FIR. It is best to give them everything in writing and handover the tool to them. Then they will investigate and file chargesheet (if they think offence has been made out). You will only be called to court during the evidence stage for examination in chief and cross examination. But if you don’t actively pursue the case, it is likely that the other side will bribe the cops / prosecutors, and will be able to get away.

HMake complaint in writing to the police and mention all the fact and evidences (including names of any eye witnesses, if available) you have against the Accused in a clear manner.

SI did file case they were arrested but someone came to intermediate between us and my family members were there they also keep on insisting to not go ahead so I back down because currently I am jobless and I don’t have enough to pay lawyers fees.
But the fact they attacked me first and don’t even hit them back they just got away by saying sorry it just makes me angry . I am feeling that I let them go away with such severe offence . I wanted to beat the shit out of him .

UFirstly is there any recording or witness of this then we can think about filing a case and to be honest the legal fees is a different issue the judge may rule it as a mere street fight and might make you pay fine for wasting so called courts time

SNo recording is not there but my mama’s son and his friends saw when he hit me with a fight

USir tbh I am not exactly sure I am a clat aspirant and currently 16 but I wish you find appropriate help, about the too much court kacheri. First file fir the police will look into the background of those people and do inquire if they have any other such records if yes it will make your case stronger and to avoid too much court kacheri just ask privately for out of court selltment
