        I am fighting a case about Sexual Harassment at Workplace. This case is right now in high court as the respondent tried to quash the case.

        My lawyer is more like a friend. I still have some questions regarding the procedures I am following-

        1. I have already 60000/- for the Allahabad Court Lawyer. For which ai had to visit Allahabad, get my pictures and they did some procedures and all.

        2. Next hearing is approaching soon. My lawyer/friend wants me to write replies for the application that respondent’s lawyer sent to high court.

        I would like to know if it is my job to do that or my friend/lawyer is slacking.

        Need genuine, helpful responses.

          The best is if the client writes it. That way it is ensured that all the essential information and facts are there and not missed.

          A lawyer will then vet it in legal language, format it and file it in court.

              Bro you should get a professional lawyer, it is his duty to send a reply, it is a legal reply in court proceedings not just any reply to a message.

                      Did your lawyer appear on the previous date or not? Well setting it aside, it doesn’t matter who drafts the reply, because in both cases it is to be self attested by the party. But it would be good if a professional does something in which they are trained in rather than someone who can commit some mistake without even knowing.

                      Lawyer here. Your Lawyer is supposed to draft the reply not you. Making you draft the reply will turn out to be a disaster. Get another good lawyer instead of that scammer.

                        When we draft Responses or Rejoinder to a petition (especially in personal law cases such as matrimonial cases, which tend to be very fact-based), we ask clients to prepare a para-wise reply. Basically your answer (eg. denial to certain allegation / correct version of events etc.) to every point the other side has made. Even in commercial matters, we ask the client/company official to give us a para-wise response. Then we draft the petition as per your responses. No one expects you to know or cite the law. It’s only limited to factual information that your lawyer is not aware of. It’s very routine and you should cooperate with him.

                            Sure! He has been with me and very helpful since 2020. Thanks for your response.

                            But asking this, I just wanted to make sure that I am not doing something that I should not. I couldn’t ask him because I didn’t want to express my scepticism.

                                I would write my facts and responses and send to lawyer; they will discuss and remove or add any points or edit my points in legal language, make corrections as required. confirm the final draft with me and then I sign before they present it in court.

                              Lawyer from delhi here.

                              We need the story from the client and then frame it into a proper legal language and arguments. So if it is for that, this is correct but if he is a good lawyer and has all the documents of the case, he should be the one doing it. That’s what I do at least.

                                Replies are prepared by the lawyer, but you are required to provide facts. As the person involved, you have the best knowledge of the facts of your case and would be in the best position to factually respond to the case presented by the other side. However, it is important to note that a layperson may not be familiar with all the legal requirements, so your role ends with providing a factual response to your lawyer. After that, it is your lawyer’s responsibility to draft a reply using the facts provided by you and incorporating any necessary legal responses.
