Whose name as ‘head of the household’ should be filled in self-enumeration form during house listing survey 2026?

My father passed away in 2022 and we are only 4 members now : My mom and 3 brothers. But on papers due to some legal complications, my mom’s name cannot be changed and replaced with my father’s name. So whose name should be filled in the House Listing Survey, 2026? One is deceased but papers have his name or my mother who is alive but does not have her name on the paper? I’m trying to find an official confirmation regarding this but can’t find any.
