        India has a huge population and a *lot* of pending cases as I understand, and it takes ages for court decisions to be made currently because of under-capacity. So why aren’t we adding more? Is it primarily a lack of funding by the government because it isn’t enough of a priority task compared to other issues or more a lack of enough qualified people studying to become lawyers and judges? If the latter, shouldn’t salaries for lawyers skyrocket and make it a very lucrative profession if there’s high demand but not enough supply?

        Also (though this is probably a separate question), what kinds of cases most commonly cause these pending bottlenecks?

          Coz India is a Banana Republic, all this is to ensure people suffer and keep paying the lawyers.

          It’s by design like the way the Government is/was never interested in improving the ease of living.

                        I can understand you speak in hindi and no offence also. But I don’t understand. Entire post is written in english. But why do people expect whoever is coming to read comments might know hindi ? Of course i know broken hindi but its your choice too. I wouldn’t comment ever on a post in tamil or kannada or any language unless the post and subreddit itself is related to that language.

                        Not a fight or offence or even hate towards hindi. Just wondering what led people like you to do so.

                                Most Indians do not have the education levels needed for one, the government does not have the money to maintain and pay the salaries for another..

                                      Yeah i think in 2020 or smt a HC used gpt to deny bail, so similsr bots can be used for reading and summarising the precedents and fastup the trail

                                          True. Since nation is poor, it would be easier to create AI for assistance.

                                          And lawyers could even be bypassed is smaller cases.

                                              The Indian Judicial system has been expanding rapidly in the last two years or so. Because what you said seems to have been realised by the upper levels. For each State, you can check out their website & see the employment listings & openings.

                                                Because it’s not about the number. of courts or lawyers.

                                                The current practices reward the lawyers to make more money by dragging a case rather than ending it quickly and stop the cash flow.

                                                Until that is corrected, nothing is going to change.

                                                    There has to be a limit on how many cases a lawyer can take at a time. Successful lawyers have hundreds of Cases which means the date often clash or they cant make proper preparation so they try to postpone cases
                                                    And the most of these Lawyers are old like Kapil Sibal age so Judges who are obviously younger are scared or intimidated to deny thier requests

                                                    India actually have a huge number of Law graduates who are doing non law jobs. Their is no shortage of Qualified people. Simply Government not investing in courts, police stations and personal. Also not updating laws to close loopholes and ensure speedy trial. The amount of Judges, prosecuters per population is laughable.

                                                      No incentive. Why waste more taxpayers money when you can already prolong cases for decades without any consequences. I have never seen any judges get praise or prize 🏆 for quick resolution of cases. Infact, more they prolong cases , more payment is got by lawyers. So actually they HAVE AN INCENTIVE to prolong cases

                                                              Right to be heard & right to appeal is fundamental- that means if I ask for an adjournment, the court has to grant it

                                                              Either one or the other party would keep on asking for more dates to present additional evidence, bring in more witnesses etc

                                                              So the matter just keeps on dragging and dragging

                                                              Also if a verdict goes against you – you are allowed to file an appeal to a higher court & then the whole process begins again

                                                                We actually need more police officers traffic police judges etc etc. we have 50% or so vacancy in traffic police i think and we have a lot of unemployed youth

                                                                Just filling these vacancies would solve multiple problems

                                                                  Look at the requirements to become a judge, you’d be geriatric by the time you actually get there, these are the problematic generation anyhow who have created the current system that manages to punish every innocent and release every criminal posssible. How else do you expect the rich to line their pockets? 🙂

                                                                  There’s no shortage of lawyers and law students but most lead a shit life, the majority of lawyers aren’t leading a life from suits, go to any municipal court. They are still using typewriters and filing documents for 100rs a piece.

                                                                  The only shortage this country has is that of young people in high positions of the government

                                                                  It’s a game of money, if you don’t create a problem you can’t sell a solution. If no one gets sick you can’t run hospitals, if everyone has a house no one will pay rent, if everyone has food no one will pay for it. If you solve cases in 1 day you can’t drag it out for 7 generations for lawyer fees

                                                                    Because the new courts will get clogged with more cases of family and property disputes. Govt should rather make clearer laws on land ownership and inheritance so that such cases get resolved quickly

                                                                      The biggest problem is the unethical and unprofessional behaviour by lawyers. Most lawyers don’t know how to litigate in India and all they do is waste time to try and put pressure on the plaintiff (the person who files the lawsuit).

                                                                      Most judges are honest and hardworking despite the misconception that people tend to have. However, there are about 20 to 30 stages in each case and if the opposition lawyer claims to be sick or busy or comes up with multiple delays at each step, you can imagine what would happen. Let’s say the judge tries to be quick and gives a hearing after 1 month each time. However, 5 to 6 hearings go by for each stage. Now multiply 6 by 30 and you will get 180 months. Plus some holidays, strikes by lawyers, judge sick or on training etc. So even a very hard working judge can’t close a case in less than 10 years!

                                                                      The lawyers in India are total goons (not all but most) and have a LOT of power for unknown reasons. The police and the government don’t dare take any action against them due to fear. They routinely set courts on fire, beat up the police including senior officials like DSPs, threaten judges openly and of course beat up litigants and their attorneys. Nevertheless, no government or police force in any city or state in India ever acts against them. Even the judges are powerless against them as the police doesn’t act. So, yes, more judges are needed but the main issue to be solved is to stop the hooliganism of the lawyers.

                                                                          That’s wild. Why don’t the police act? I understand politicians or others with a lot of black money could influence them, but how lawyers? Do they also pay the cops off?

                                                                          And how many approximately as a % would you say aren’t good at law? I assume AI assisted good lawyers who can assist more clients would probably become in higher demand then.

                                                                          It is lack of intention. And system is currently working on 10-15 years delay and everyone is misusing it accordingly. Making it fast forces one to be efficient and bear punishment too if required.

                                                                              And I would urge you to go to courts to see the quality of judges in general – specially young and new ones. It’s quite pathetic.
