VI recently visited the Kumbh and was absolutely shocked—these so-called Babas are openly smoking marijuana, right under everyone’s noses, even though it’s clearly illegal under the NDPS Act! How on earth are they getting away with this blatant law-breaking? It’s infuriating that our legal system seems to give them a free pass simply because they’re wrapped in a veil of religious reverence. It’s almost laughable that I can’t even consume or buy it legally, yet these Babas are living it up like they’re above the law.

EThey are smoking marijuana which was legal until the Americans forced everyone to make it a grade A drug (fuck Ronald Reagan). This plant has been consumed by humans for centuries, long before our codified laws existed, so the law makes it an exception for them and other culturally significant rituals. They aren’t above the law they are permitted or you can say not scrutinised for it.

LLawyer here. First understand that the words “use” and “consumption” have different meaning in NDPS act. Section 27 of ndps act governs consumption. Only *UPTO* 6 months jail and fine is levied that too governed by the procedure mentioned in crpc and not ndps act.
If you prove that you’re an addict, then no jail and fine.-

LGetting arrested for few grams means that you’re caught with possession. Possessing even a single gram of marijuana can be fatal. At the same time, consumption is relaxed.

A person can be tried under section 20 for possession even if that person never had marijuana. -

URulers and governances have came and went but these people, cut off from society have been consuming cannabis since ages, britain criminalized it and then a century later half of Europe legalized it so instead of complaining about them you ought to be asking for the governance to legalize cannabis instead.
