I was reading about this case in Kerala where a woman, Greeshma poisoned her ex boyfriend and then thought of the Curry and Cyanide case of Jolly. Why did Greeshma get a death sentence when Jolly wasn’t given considering the number of casualties of Greeshma was 1 and Jolly was 6 (including a toddler)
Shouldn’t Jolly’s case be considered more cruel and rarer than Greeshma’s?

Β Death sentence is supposed to be given in rarest of rare cases. Whether a case falls in this category is the interpretation of the sessions judge.

Things are more uniform in higher courts
Most death penalties get commuted to life except for terrorist cases

Because Jolly Joseph’s case is still on trial and hasn’t reached conviction yet.

Greeshma-Sharon case had some specific details, which the judge considered as the rarest of the rare. The pre-planned nature, the gruesomeness of the crime, the relative lack of remorse (almost showing a ‘victorious’ feeling of coming out of jail after 14 years), etc, was used against her. Now, it’s obvious that her sentence would be reduced to life, possibly with a parole after 15-20 years once the case reaches a higher court(a life term without parole would be more appropriate imo). Jolly’s case, as has been pointed out, is still in the trial stage, and it is very likely that she’ll be sentenced to death as well
