January 27, 2025 at 7:56 amMy uncle had two sons, the elder son died last year and has left his wife and son but the catch is that they weren’t living together for past 13 years also no divorce or seperation petition was filed . So now we are selling an ancestral property in which my father and my cousin brother have their share and my cousin (uncle’s younger son ) is wrongfully taking her share on the context that wife doesn’t have any right in ancestral property. Is this claim any way going to stand or he will have to give up her share? -

January 27, 2025 at 8:41 amNope, elder sonβs wife and son have their right of share.. but they might not be interested considering it has been 13yearsβ¦ if they were they could have asked for it on their own.. you donβt have any say in that.. let the younger son and his sis in law decide what they want to do with their share..
