        Suppose wife filed multiple fake cases ex dowery, abuse etc and the case is going on and she is asking 1 crore alimony can the guy go abroad for Masters or Onsite.

          You’re cooked bro. You’ll have to come back to show up in courts, else after x number of summons you’ll be on arrest on arrival. They’ll also start seizing assets under your name, not a happy place to be and you still need to contact embassy for passport/visa or xyz renewal.

                  Criminal case cannot proceed in the absence of accused.. though accused may ask for presence via video conferencing given such infrastructure is available in the court , butt since district court’s lacks basic infrastructure and skilled person to conduct proceedings they may not be inclined to allow it .

                    it could take anywhere up to 8 years. and she just needs to have that one rupee she transferred or any money she spent on him or any gift she gave him or she could even say her family saved up cash for her wedding for years and it was given as dowry!

                    or she could even say that the ornaments, clothes, jewelry she was given by the man and or his family was taken back(even if not), cuz the court considers it as stree dhan!

                    or she could record that one time he shouted in response to her shouting but could only present his shouting in the court!

                    or, she could just bruise herself, go to the hospital, and get a medical done to confirm there were bruises and have that as proof in court!

                    the law works solely based on facts, even if the judges, lawyers and the parties involved know it well enough, they have no choice but to go by the book!

                        Some senior lawyer working in Delhi HC and SC recommend not to return to India if DV or 498a ongoing as they can manage to take its tooth & vindictiveness in few years time. However with Parents and close relatives back home, its a difficult option to consider

                                If he goes it will strengthen her case for alimony that hushband have all the money in the world , and escaping abroad only lengthen the process since he doesn’t acquire citizenship his passport can be cancelled and warrant may be served on embassy for his deportation

                                          Yes but leave before your passport gets confiscated. She may turn around and tell the court that she suspects that you will flee. It happened to someone very close to me.

                                          Give POA to attorney and make avail of your rights to file civil cases etc.

                                            If you are already outside India don’t ever return . They can’t touch you .. they can harass your parents thought . But if you are in India and they have already filed an FIR against you and you have a criminal
                                            Case pending against you .. you may not be able to get a visa ..
