May 6, 2025 at 1:13 pmHi,So as the title says. My wife(the wonderful driver) grazed a car and the guy spoke to his mechanic apparently and demanded 3,500 to get his car fixed. He took photo of her license and car. She did the same. He kept on demanding money. My wife stayed on the spot for 20 minutes but eventually left. (This is in pune btw).
Question – should I be worried about anything here ? Should I go and file a complaint myself ?

May 6, 2025 at 1:24 pmHi . Thank you for the quick reply.No demand made yet. Has been literally an hour since the incident . My wife is scared because he threatened to go and file a police complaint. She and I also are a bit worried about dealing with cops unnecessarily. Is there any legal stand that he has ? I have comp. Insurance and it can easily cover the damages. According to photos . It is a small scratch. It shouldn’t cost more than 3000 rupees to fix.

2. Pay using Insurance (You lose No Claim Bonus); Or
3. Argue and refuse to negotiate and settle, deal with Police, etc.

She didn’t flee the scene (was there for 20 mins). He kept demanding money instead.
Had I been in his situation, what would I complaint against exactly ?-

May 6, 2025 at 2:28 pmDon’t understand your estimate is at max 3000 and he’s asking 3500? What’s the deal just negotiate for 300p or pay the extra 500 avoid the hassle. I mean he has to get it fixed so you can pay the extra 500 for his time?-

May 6, 2025 at 2:30 pmMy point is why should one have to pay when there is insurance available. Asking 3500 flat was weird.My car was hit in the parking and had to be repaired. Estimates were 11000 which got covered by the insurance.
How is it fair to make a person shell out money for this.

May 6, 2025 at 2:29 pmWhatever the outcome, if there is a settlement towards covering the damages, op shud hav something in writing from the other party as consent or agreement in full settlement else he cud always file a case later on. Don’t go by oral assurances.-

May 6, 2025 at 4:24 pmIt wasn’t her fault. He came out of a gate and hit the car from the side. The back door area got swipped. His day was ruined by his own actions. I didnt know the car was hit from the side and that too rear part. He bumped into her.-

What happened to your wife happens every 5 minutes in Delhi. Indians are bad drivers because government is corrupt. Period.
Gender has nothing do with it, and your wife certainly doesn’t.

May 6, 2025 at 5:46 pmIdeally, your insurance should pay for the third party damages.If you don’t have it, you can settle the matter, either by paying the cost of fixing, or compensating the other party the amount they would have lost on having no claim bonus waived off + some amount for their time/effort/cost for rental car in the meanwhile.
He can get his own insurance to fix it. You can offer to pay the no claim discount plus, cost of a rental car until his own car gets fixed, plus cost of their time.
I’d try to settle the matter by paying 5k and moving on (that is in the case he uses his insurance). He’s too generous he’s just quoting 3.5k.
