        Hi,

So as the title says. My wife(the wonderful driver) grazed a car and the guy spoke to his mechanic apparently and demanded 3,500 to get his car fixed. He took photo of her license and car. She did the same. He kept on demanding money. My wife stayed on the spot for 20 minutes but eventually left. (This is in pune btw).

Question – should I be worried about anything here ? Should I go and file a complaint myself ?

        Thanks.

          Lawyer here.

          – Has any demand been made after your wife left?

          – What’s your estimation of the damage done?

          – What do you want to write in your Complaint?

Hi . Thank you for the quick reply.

No demand made yet. Has been literally an hour since the incident . My wife is scared because he threatened to go and file a police complaint. She and I also are a bit worried about dealing with cops unnecessarily. Is there any legal stand that he has ? I have comp. Insurance and it can easily cover the damages. According to photos . It is a small scratch. It shouldn’t cost more than 3000 rupees to fix.

                  It’s open for you to:

                  1. Negotiate and settle when he demands; Or

                  2. Pay using Insurance (You lose No Claim Bonus); Or

                  3. Argue and refuse to negotiate and settle, deal with Police, etc.

Just curious about the 3rd option. Is there any crime that can be reported ?
She didn’t flee the scene (was there for 20 mins). He kept demanding money instead.
Had I been in his situation, what would I complaint against exactly ?

Yes, an FIR for Rash and Negligent Act can be lodged.

But shouldn’t that act be endangering human life ? This happened at less than 10kmph at a turning

You can try arguing with the Cop to not register an FIR since the speed was less. Any Dashcam footage would do good too.

Just ask the scratched car owner to send the bill. If it is 3000 then letโ€™s see

Don’t understand your estimate is at max 3000 and he’s asking 3500? What’s the deal just negotiate for 300p or pay the extra 500 avoid the hassle. I mean he has to get it fixed so you can pay the extra 500 for his time?

My point is why should one have to pay when there is insurance available. Asking 3500 flat was weird.

My car was hit in the parking and had to be repaired. Estimates were 11000 which got covered by the insurance.

How is it fair to make a person shell out money for this.

I understand your point but it is what it is. You either pay around 3k and don’t hear from him again or you take the longer route but it will consume your time. Imo everything works like this in India.

Whatever the outcome, if there is a settlement towards covering the damages, op shud hav something in writing from the other party as consent or agreement in full settlement else he cud always file a case later on. Don’t go by oral assurances.

Ask other person to send demand letter. And share the sa.e to your insurance for 3rs party claim.

Your estimate is 3000, what about the unnecessary stress, and the day ruined by your wonderful driver wife? I think you should pay it off as his day was ruined by the unintentional action of your wife and it is our responsibility to make things right.

It wasn’t her fault. He came out of a gate and hit the car from the side. The back door area got swipped. His day was ruined by his own actions. I didnt know the car was hit from the side and that too rear part. He bumped into her.

Bro, first of all. I think you may also need marriage counseling.

Your wife… “the wonderful driver”. That’s as passive aggressive as it gets. It’s not healthy. What happened to your wife happens every 5 minutes in Delhi. Indians are bad drivers because government is corrupt. Period.

Gender has nothing do with it, and your wife certainly doesn’t.

You’re right. I’m sorry about putting it that way. Will edit the post as well.

Ideally, your insurance should pay for the third party damages.

If you don’t have it, you can settle the matter, either by paying the cost of fixing, or compensating the other party the amount they would have lost on having no claim bonus waived off + some amount for their time/effort/cost for rental car in the meanwhile.

He can get his own insurance to fix it. You can offer to pay the no claim discount plus, cost of a rental car until his own car gets fixed, plus cost of their time.

I’d try to settle the matter by paying 5k and moving on (that is in the case he uses his insurance). He’s too generous he’s just quoting 3.5k.
