April 3, 2025 at 7:45 pmHi,I 35M got married to my wife in 2020 and she stayed with me and family for 6 months and fought and left home. It was only recently we discovered that the suitcase in which the 3 property papers were kept were missing and during the same time she called my parents to threaten them with dowry case and told them about the property papers. My father is 70+ and he didn’t have the presence of mind during the call to record it so we couldn’t gather the proof. She and my mom had some fights during lockdown as immediately after marriage lockdown happened and both are short tempered so things worsened. She and I kept meeting outside until now and she did not show interest in staying separately nor coming back. Now she is threatening a dowry case on whole family my parents and sister who is about to get married (so has lot to loose) and is asking for money and also stole the property papers. She has a brother who is also divorced but we didn’t see a red flag before.
What action can I take? Can I make an FIR on lost property papers on her and have some leverage?

They are men’s rights activists fighting false 498A cases, dowry, alimony, maintenance, etc. They have made documentaries, gone to Supreme Court, have contacts with police, voice heard in Parliament, been in newspapers and on TV news channels. They have helped many men in distress.-

April 3, 2025 at 8:13 pmNAL1. File a police report that property papers are stolen. Donβt say your wife took it. Let the police investigate and come out with your wife as the thief. If you need to bribe, bribe.
2. File divorce on basis of cruelty before she files 498β¦etc.
3. Then wait. Most sensible advocates will suggest the same.

April 3, 2025 at 8:45 pmIf you had recorded threatening convos of her to your parents, once the police establish their findings, you can file for elder abuse as well. Note: she will retaliate with 498β¦etc. but if you file first, and get the police report with elder abuse and such (with proofs) she wonβt go that far, and settle with mutual.

April 3, 2025 at 11:43 pm1. Lodge a police report for missing/stolen papers, and the follow the process for duplicates issue from registry office. You may get mutation details & annual cess paid online these days -as a backup to prove ownership
2. Make up your mind to dissolve your marriage. Consult a lawyer.
3. Silently file a informatory petition in local cjm/district court with details of her misdeeds and thefts, deserting, giving threats etc. subsequently file divorce petition
4. Later get a dv petition filed by your mother against your wife. If possible, get a restraining order granted
5. If situation get worse and she keep coming to threaten, let ur dad visit local thana and file a complaint. And request for protectionUltimately, prepare for a long nonsensical legal battles leading towards some kind of settlement and mutual divorce. In the meanwhile keep paying (with records) some amount every montj – so she cannot push harder for maintenance

April 4, 2025 at 5:03 amAn NC complaint, or Non-Cognizable complaint, is a complaint filed with the police about a non-cognizable offense. The police will record the complaint in the General Diary and advise the complainant to file the complaint in court. While in court proceedings , this gives more weight to the threats and dv claims.

April 4, 2025 at 11:05 amHonestly great advice. For my mamus case when our lawyer raised point 4 , my family denied sayin no lets not make mami’s life bad, this is family issue lets not put it out; we just need a clear divorce but guess what after suffering through 8 years on false dowry and 498a case, all of us regret following the lawyers suggestions.

April 4, 2025 at 10:05 amI can tell you a good advise of asking your sister to file a rape case on her brother and settle for next to nothing, but you are too weak to do that so I must say suffer -
