        Hi family,

        I got married in Dec 2023. I am working in a startup from my home and earn decent amount. Just after one month of our marriage, my wife started complaining about everything. Everyday she fights with me but I managed. She went home in June 2023 by saying I don’t want to live with you. But after talking to her father she came back in September 2023. She and her mother constantly abuses me behind my back and one day I heard everything. I kept a voice recorder just to know what exactly she and her mom are planning but I got to know that she has been talking to some guy behind my back. After recording all this one day she was fighting with me and called her family and I told them whatever was going on. She even accepted that she was talking to him (I have voice recordings). Then her family took her with all the things (Clothes, jewellery etc )

        Now after 6 months I got a call from her local police station saying that your wife wants to file a complaint against you and your whole family ( including my cousins) for DV and Dowry. I went to police station and there she said that either live with me or pay 25 Lakhs.

        Can anyone help me what should I do next? I talked to a lawyer and he said that nothing will happen. I told my wife that please settle this and go for a mutual divorce but she is saying she just want to live with me with some conditions that I should move to some other city with her. She doesn’t want to live with my family. Me and my family never asked for any dowry amount and didn’t even touched her (DV case).

        I only have voice recordings of her talking to the guy.

            NAL Bhai get a settlement like the one registered ig called in court settlement pay the 25 lakhs . By now ig You would have gotten a idea how laws work , tomorrow she will make new acquisitions and only you and your family be affected. You have a long life ahead pay the amount . Bargain and get it lower if you could . And get rid of life and continue with a new start considering you dodged death !!!

                I took some loans for my marriage and all my salary goes into paying the emi. I tried to negotiate the amount but she is not agreeing.

                    Bhai detail dena thodi how much loan emi and how much your salary is ? Bhai you work in corporate you must have a good info that money spent on wedding is zeroooo . it’s just show off kind of thing . Why would you take loan buddy

                    Get a proper recording of her saying ‘either live with her or pay 25lakh’

                    From a legal standpoint going into case will be too much painful and long process. If things are good then it will take 3-5 years for the case to finalize.

                    Best will be talk to a proper lawyer one on one, someone who is from her area. Get 3-5 openions. And ask them all sort of questions and scenarios.

                    Sadle but her talking to another man is not a good reason and won’t stand in court.

                    Getting back to her is a disaster as she already involved police without informing you/talking to you before.
                    She has gone to the police and will definitely go in the future.

                    After having a proper Convo with your lawyers then chose the appropriate path.

                          According to me the practical thing to do is somehow manage 25 lakhs and convince her for mutual divorce, this scenario will significantly reduce the suffering of you and your family because once a fake case is filed it wont be stopped, you will be trying to prove yourself innocent in one case meanwhile your wife and her lawyer would be planning to file another on your mother and one on your sister

                              Married women with 0 conscience are the bane of Indian society. This is how things will go if you don’t pay the 25 lakh.

                              She will file fake cases on entire family. She doesn’t have to come to court, but you have to attend every hearing for 498a. Then, you get acquitted like 3-5 years down the line. In the mean time her lawyer will file maintenance and take money from you regardless. You will file for divorce after 2-3 year mark. And by the time you’re out of all these cases, you’ll lose money and time.

                              My suggestion: record everything and get a divorce. Then file threatening criminal prosecution on her. And ask her that if she pays half of it back, you will not pursue this.

                                1. Talk to your wife nicely as if you are ready for reconciliation. Let her say the things in a message or record the conversation. Don’t let your emotions take over.

                                2. Talk to the police and convince them that she is trying to file a fake case as you have not demanded any dowry from her. Show them the recording, but don’t hand it over to them. you need them later on (if FIR is filed). If they ask, you can only share a copy. If cops get convinced, they will not file the FIR, they’ll call both the parties, advice and send them away.

                                3. You can take your wife to a counsellor, if you feel you can continue with the marriage.

                                4. Or else, you can go for a pre-litigation mediation facilitated in the medication center attached to the Family Court or Civil Court. Ask her to agree for a mutual consent divorce. Don’t let her whole family to make decisions for her. You insist that only she will participate in any kind of discussion. Be it with police or counsellor or mediator.

                                  With the help of recordings you can file for divorce case on the ground of mental cruelty, no need to pay hefty amount in lump sum, engage a good family lawyer who can negotiate the alimony amount. If that does not sort out then court will affix monthly maintenance i.e. 10-20% of your monthly income.

                                    1. Get a lawyer and file for anticipatory bail if you think she’ll put fake cases.
                                    2. File a harassment & fraud complaint along with the evidence. However the evidence may be insufficient as it wasn’t recorded with consent. Something more on chat will be better.

                                    This may bring the settlement amount down

                                            Sometimes private discussions aren’t allowed to be considered as evidence, so people leak it on social media hoping it’ll work out as public information from there. Tricky stuff

                                                I would suggest hire a killer lawyer show up in station he/she will scare the crap out of both police and your inlaws and settle for less then half or nothing and get rid of leech of a wife. (Dont worry paying your lawyer an extra 50k if he/she does an awesome job).

                                                    You need to get out. ASAP.
                                                    1. Get some evidences such as recordings.
                                                    2. Talk to lawyer & Follow lawyers advice (find a lawyer through reference, so that you can have some sort of trust/faith in him)

                                                    You will certainly need to pay, but hopefully not 25L

                                                        I know and I am willing to pay but 25 lakhs is just too much. I cannot afford to pay that much amount but thanks for the help I will definitely talk to a lawyer
