SSuppose I marry a girl who earns more than me and then we get a divorce. Will I get the alimony or do I have to pay her the alimony inspite of earning less than her?
In a little different scenario, what if I earn more than her but she has a higher net worth than me. What would happen in this case?

Men in India can only get alimony if they’re completely destitute and/or handicapped to the extent they can’t do any work
Women on the other hand get alimony as long as they earn less than thier husbands, even if the difference is not substantial. Hell there even have been cases where the courts have provided alimony to women who earned MORE than thier husbands

It’s not about who earns more or less, but about **who’s better off and who needs the support**. The court looks at **several factors** — not just income, but also lifestyle, earning capacity, and how the separation impacts your financial situation.
1. **If your wife earns more than you**: No, just because she makes more doesn’t mean you’re automatically out of luck and won’t get alimony if you need it. But let’s be real — if she’s doing well financially, the court’s probably not going to favor you getting alimony unless you can prove that you can’t support yourself. If you’re just sitting around doing nothing, **that’s on you**. You’re not going to get a free ride just because you’re too lazy to work.
2. **If you earn more, but she has more assets**: Money isn’t just about monthly income — **assets matter too**. If you’re raking in more monthly but she has a bigger net worth (say, through inheritance, investments, etc.), it could affect the outcome. But generally, the court focuses on who’s better off *now* and who needs the support. They’ll look at your income, her income, and how much **you** can reasonably earn in the future. 4. **Unemployed, zero net worth**: If you don’t have any money, then the court can’t exactly force you to pay alimony — **but** that’s if you’re truly broke. If you’re living with your parents and doing nothing, the court will still consider your future earning capacity. If you’re capable of working and earning, they’ll make sure you get a job, whether you like it or not. So, don’t think you can just sit around and call yourself “unemployed.” **They’ll make sure you get off your ass and contribute** if they have to.
5. **The cousin and the weed-addict example**: Yeah, I get it. You’ve got an example of a guy who’s a weed addict and still getting by because he helps his dad in a business. Well, that’s his life. LThe reason for Alimony is not just lack of support, it’s the lack of cumulative job experience due to years of homemaking making the unemployed party continue to be unemployable in their chosen sector.
Because everything else works the same for men and women. Future employability is a nebulous thing to judge such cases by because both men and women have the same opportunities in the future according to the measures mentioned here.

CWhat if I simply deny that I will not give single penny after divorce ..what will be the worst case scenario..they will put me in jail or auction my property to give her the alimony ..if I don’t have that much to give even if my all property to auctioned ..wht will happen ..I have not done any murder or anything..that they will put me in jail for lyf long or hang me ?

SWhy are there so many people replying who don’t know the law at all? Alimony is granted when it’s proven in court via proper documents that the spouse is incapable of maintaining their livelihood if the divorce happens and that the divorce is happening because that other richer spouse is the reason of the said divorce. If the other party has a source of income they will not get alimony. It’s not who has more or earns more it’s if the other party will be able to eat and live once marriage is dissolved. Also a good lawyer is mandatory as many lawyers drag the cases and take money from opposite party to not settle favourably. And of course whoever gets the kids, if any, gets child maintenance when the other party has considerable income/wealth.
