April 18, 2025 at 2:55 amI am making a game for adult audience which are not targeted towards Indians. I have heared that these things are illegal to do in India. I have thought of a way to tackle this. I will use a patreon account for funding the game. I will use it to upload dev logs and some decent images (not obscene at all). Then during the time of release, I will send the game personally to each one of my patrons and for public release, I will release it for free on a piracy site.Will I get in trouble? Because technically, I am earning from the information I give regarding the game and not the game itself.

April 18, 2025 at 3:22 amYes it is a crime. It’s considered as distribution of obscene material which is illegal. It’s not about the price. Even if you publish it for free, you are still held accountable for distribution. Even sending them to your patreon subscribers privately is a crime.-

April 18, 2025 at 6:35 amYes. Copyright is one thing but once you publish, your digital signature can be and will be tracked if it is deemed necessary. I advice you register a company in a different country and release/publish or share under that shell company.

April 18, 2025 at 5:55 amBro legally it is crime, but as long as you have servers out of India and don’t try getting large traction on India you are safe. I am Not A Lawyer but as far as I understand the system, it’s just that content should not be on Indian serves, if it is not there’s nothing that could go wrong. I might be wrong but going by real law situation it’s not a big deal, nobody is coming after you if you try and stay a bit out of limelight.-

April 18, 2025 at 6:36 amThat is not a problem because the funding app I will use is not Indian based nor are the people who play the game.(I don’t have much knowledge of what I am going to say next, please don’t judge me) Someday I would have to file an itr, and in that I would have to mention my source of income, that is what I am really afraid of. I believe it can be traced back to me somehow. I mean I don’t have much knowledge on the subject so I may be wrong.

No matter where you are getting money from, if it’s taxable and you file your taxes in time nobody cares the source, you can show it as your business income as other business category. This works and nobody cares, unless you start making millions our of nowhere overnight. Capitalist .net, check this, won’t explain what it is but might come handy later…-

Know a few people who are doing similar things which might not be entirely legal here earning lakhs of rupees a month, some have been doing it for years now but no trouble, income tax is only trouble here, better get in touch with an experienced CA if you income gets to higher levels and they can easily sort it for you, ofcourse at a later stage. And by the way, best of luck for your side hustle..

April 20, 2025 at 3:48 pmIf it is not hosted on Indian servers and the target audience are not indians, you should be fine. I think even if people use it in India, and your content is not hosted on Indian servers, it should be fine. Not a lawyer but have done some research around something similar.-

April 20, 2025 at 4:27 pmI am planning on using Patreon and as far as I know it isn’t an Indian server, and the target audience is definitely not Indian. But my biggest concern is filing an ITR and if I can get into trouble because of it.
