      You don’t have to pay anything but be stern and ask for an FIR.

      If required, you can also collect any cctv footages from the shops where the incident occurred.

      If they file a case, you need to keep the vehicle in the station for 1-2 days and then they’ll release it.

      Compensation should go from your 3rd party insurance and it’s a norm in India to threaten the driver and extort money in case of accidents. Take a local strong guy (behaviour wise) if you have to visit the police station again.

        I think this is a standard procedure. If you don’t sign the NDA / NRA, i guess they may proceed with your termination since you are not cooperative.

        Usually Ethics committee will comprise of a few people and they’ll try to ascertain the facts first with respect to the complaint they received.

        I know for a fact that people have come out of the enquiry successfully since the accusations couldn’t be proved and in some case backfired on the complainant as well.

        If you are 100% sure of no wrong doings, nothing wrong in appearing for the enquiry. I have a strong feeling that they’d not disclose anything to a lawyer you hire citing confidentiality.

        Your lawyer possibly will come into play only if you are terminated and still doubt they can do anything related to it since your joining letter / signature will have clear clauses allowing the organisation to terminate you on multiple grounds.

          Ask him to do an apology and get away with it. If he’s not willing, he might as well look for a job so he has a new work environment where he doesn’t have to face this person again.

          That’s a decision he has to take. While it’s fair for him to think it’s a genuine mistake, he can’t expect everyone to let him go when someone feels offended about it.

          PS : I never felt bad in apologizing even to the team if I think I made a mistake. Am sure the HR is asking for a 1:1 email & not to an entire group.

            Thank you.

            Is there a counter argument they can file ? Reason I ask is, there was no agreement made in the first place – deposit was transferred via Gpay and I have the transaction details.

            Also, any possibility of getting a “stay” so they can’t rent out the space till the issue is sorted?

              Have you taken a video pre / post return ? If so, you can always deny it.

              When I rented a bike in Mysore, I took a detailed video before delivery and after delivery.

              They first wanted to check if you have a proof before threatening you. Ensure you get hold of the video, but don’t share it.

                  The details may not be in the offer letter but check HR policies. Should be mentioned somewhere and a normal thing.
