March 1, 2025 at 12:35 pmNo, I didnt’ spend a single ruppes from my side cause I fought it all alone. but the major investment was time.I have invested around 10 months in this whole process. offcurse, it did affect my work. my job is very demanding and handling all this drama side by side was very challenging. and for me 1 lac rs amount is very big – It was some good % of my savings. I couldn’t have just let it go. I am thinking to sue them in consumer court but let’s see, will do it in some months. I am not sure tho- how much I should ask.

March 1, 2025 at 12:29 pmI have not received any compensation for the mental anguish I had to endure. I believe this does not fall under the ambit of the Insurance Ombudsman, and as you can imagine, I was exhausted from all the back and forth. So, after receiving my claim amount, I did not follow up with the Ombudsman regarding this. Now, Iβm unsure whether I should email the Ombudsman again now to pursue the βΉ30,000 I had claimed for mental anguish or take the matter to consumer court and seek compensation there. **Iβm also uncertain about how much I should ask for. My claim amount was approximately βΉ1.2 lakhs.**I donβt know if I can outright call Niva Bupa a corrupt insurer. My previous claims were processed smoothly, but those were for smaller amounts. So, Iβm not sure – maybe any insurance company can pull a move like this if they want to, especially when the amount is bigg!. From now on, I will seek treatment only at network hospitals whenever possible. I believe this should reduce hurdles in the claim process.
Regarding My Exchange with the Lawyer
The lawyer began with a vague argument (I had expected Niva Bupa to come up with something new in the hearing, lol). He claimed that some details were missing from one of my reports. I asked him to specify which report so I could clarify with my doctor or the lab. Then, he shifted to arguing about my hospitalization, saying that my this count / that count in the lab reports appears normal which is something they had already mentioned in their emails for which I had replied them there. but nothing good came out of it.
I knew this was a weak and baseless argument. So, I told the Ombudsman and the lawyer: βIf something had happened to me, who would have been responsible? You or the doctor? The doctor is the best authority to decide whether hospitalization is necessary, even if my fever subsides or my anythung in the lab test count appears normal. I had symptoms for weeks, and my doctor, using his best judgment, determined that hospitalization was required. and for this my doctore had already submitted a letter to Niva Bupa supporting this decision.β
At that point, the lawyer was speechless. He had no counterargument. I mean, this is very fucjing basic thing man, doctor will decide no whether I should be kept under observation or not. which Niva Bupa constantly refused to acknowledge.
