April 28, 2025 at 5:40 amAs the title suggests, 1mg has sent heat sensitive medicines meant for a pregnant lady in normal packaging without taking care of the storage warnings. The medicine packaging has clearly mentioned that it needs to be stored below 25 degrees celsius.When I enquired about the shipping method before placing the order, they confirmed that the order will be shipped as a cold chain product and will be kept in 2-8 degrees celcius throughout the delivery.
But it was not delivered as a cold chain product and when I enquired about it, they said they can’t do anything now and offering the return.
I want to know what are my rights here in this case and if I can sue them for sending expired medicines and straight away lying

April 28, 2025 at 5:53 amWould you mind going through the post again? It is not about return. That option I already have in the app, I am more concerned about the way they lied and wasted our 5 days of medicinal course, and also its about sending expired medicines to be consumed by pregnant women.-

April 28, 2025 at 6:28 amA product meant to be stored below 25C is not a cold chain product . It just means store away from direct sunlight and would apply to most medicines. Outside temperature over 40c does not mean the contents of the package were exposed to that temperature.Also expired medicine means a medicine whose shelf life has expired. Courier transport of a medicine in a parcel will not result in expiry unless the parcel is left say on the roadside for a few hours.

Do you think they can send an ice box for 3-5 days to deliver cold chain medicines? Don’t say you are in a village but 1mg kindly delivers medicines to your location. -

April 28, 2025 at 6:53 amThe return is the resolution. If they would refuse return then and only then can you go to consumer court. Not even civil court.If you would’ve consumed these medications even then it would’ve been your fault for not checking condition of the product before consumption.

April 28, 2025 at 6:46 amTo all the people who are suggesting that I cut the ego and accept return.I am assuming that you are not living in a village where medicals have limited availability of medicines
Even if I accept the return and order this medicine again, they will send the expired medicine again without taking care of temperature requirements and will waste another 5 days of medicine course.
FYI, it takes 4-5 days for medicines to be delivered once the order is placed.

I would suggest to spread the word and inform others about the incident, so posting it on social media and other city subs on reddit will save others from such trouble.Its not worth going to consumer court for such issues, one simply ends up spending time energy and money.

April 28, 2025 at 7:31 amCan you sue them? Sure you can. You can sue anyone you want to. Your case will probably be rejected by court given that the resolution has been provided to you already.You were sent expired medicines for which you were offered a return.
You were lied to about the transport conditions. Yes. But again you are getting your money back. That is the resolution you are going to get.
You can consult with a lawyer, if you wish to but I don’t think you’ll get much out of it.
Also, just a side note.
It is very likely that the manufacturers of the said medicine, are not storing it below 25°C. Even if they are, they are not transporting it to the distributors at the mentioned temperatures.
The storage conditions are general guidelines that manufacturers will write of their own accord. Most medicines you buy from chemists will have the same 25°C temperature condition or the more likely “Store in a cool, dry and dark place” storage condition. No one is following it because there is no need for it be followed.
I know this because I am a manufacturer of antibiotic injections and tablets and know the industry practices first hand.

April 29, 2025 at 3:14 amI understand your frustration and yes out of 10 customers hardly 1 will know raise query, they know and that’s how they cut corners.You can ask your friend to order the similar medicine again and see if it comes in appropriate packaging, if not than I think they are purposely cutting corners.
