March 23, 2025 at 4:06 pmSo I went down this legal rabbit hole , starting from article 24 which technically allows children to work in non hazardous activities , but on further digging I found childern below 14 can not be employed in non hazardous activities as well ( from child labour amendment act 2016 ) except non hazardous family enterprise ( enterprise or organisation owned entire by a family , including farmland )Now what constitutes as “hazardous activities” well 2016 amendment act define it as 3 things – mining – dealing with inflammables and hazardous activities listed under factory act
Now none of these mention certain agricultural activities which are quite labourous or involve pesticide like chemicals ( though the child labour act of 1986 prevents children from operating tractors , threshers and harvester machines in part B of schedule ( item 43 ) )
Since none of these have a provision preventing a child from spraying pesticides in their family’s farmland, can that be considered legal or legally ambiguous?
