January 11, 2025 at 7:56 amIn an apartment, we are living opposite to each other, the camera, has been installed in a way that all audio of the living room and balcony is captured and so we have no privacy. The neighbour is very rude and won’t budge what can I do to protect my rights? Can I file a police complaint or submit a petition somewhere. -

January 11, 2025 at 11:19 amGet a qualified technician saying and certifying the audio will get captured, talk to the neighbour over WhatsApp and record their evidence of refusing to comply. As soon they install document the proof and get a lawyer and end him and his life at court -

January 11, 2025 at 4:12 pmUnless it’s a real good camera, it won’t record audio that well, you have to be right under or pretty close for the audio to record clearly. Also who has time to listen to recordings all the time, he’ll be going through hours of it to find anything useful, what exactly are you scared of? Is he recording video of your balcony?
You can purchase an audio jammer to feel more at ease. Unless he’s recording video of your inside apt, there’s nothing you can do legally. Everything posted in this thread is BS and if you somehow damage his property your will bring more problems for yourself.

January 12, 2025 at 5:21 pmBro, a camera installed outside in the balcony, where’s there’s outside traffic, wind and other factors, plus installed quite a few meters away from the neighbor.I’d like to see how good and clear it records audio under all those factors.

January 11, 2025 at 5:13 pmThere are laws against voyeurism under the IT act. Right now, it seems he’s not expecting you to escalate the situation. Get an advocate and send him a legal notice. That should shut him up pretty quick. -

January 11, 2025 at 5:30 pmYour audio is your problem. Why are you loud enough? Why is your neighbor so upset at you? Anyone decent neighbors would be able to work this out.
Why would he tell you to file FIR? Whatโs the story youโre not sharing?

January 11, 2025 at 5:27 pmIf you live in apt complex and his camera is reasonably trying to capture external footage then itโs permissible use for tracking security of public common area.If you want privacy then shield your apt.
Again, it depends on how much of their capture direction is oriented for their security or not.
You canโt demand privacy just because you happen to be within viewing range of security camera.
Again. Until we see all this we canโt make any judgement calls.
Reasonable use from their property outdoors towards common area > Expectations for not being captured.

January 12, 2025 at 5:55 amIf the camera actually captures her house than on several grounds the complaint can be made. Main ground being right to privacy.
Police will lodge the appropriate sections.
If she can hire a smart lawyer than – it can even get dirtier and a criminal offence. (Thats why i said add drama to it) Will not disclose here as we are not sure if the camera actually infringes her rights or not.

January 11, 2025 at 10:52 amHi OP, if he has installed the CCTV at his premises then legally nothing can be done. Nowadays, this is very common. Interestingly, some municipalities in major cities make it compulsory for home owners to have CCTV installed at their premises. So legally nothing can be done here.
>
Your inconvenience is the audio being captured. You can use AUDIO/Microphone jammers. It is easily available. It is legal to use Audio Jammers. It is illegal to use network/GPS jammers. Audio jammers and network jammers are different. Hope this helps.-

January 11, 2025 at 12:09 pmNah bro her issue is valid. You can’t do something that violates someone else’s rights. Any of them. For the same reason smoking is banned in public spaces, because it violates your right to life because it directly affects your health. Understand?

January 12, 2025 at 7:21 amInteresting example to elaborate your point. However, this sub-reddit is for legal advice, not ethical/moral advice.
>
If “someone’s right” or “someone’s legal right” is violated …… My answer is limited to “someone’s legal rights” are violated only. UBI JUS IBI REMEDIUM.>smoking is banned in public spaces, because it violates your right to life
Agree it does but Public smoking is punishable with fine only hence no arrest.
>You’re saying instead of asking the other people to stop smoking, go get yourself chemo therapy.
“Smoking causes Cancer” It means it causes Cancer to the people who smoke. Can’t see any relevancy to the context.
>
This is a Legal sub-reddit. Strict legal advice is expected to be provided. If there are no legal solutions then some out of the box solutions may help.-

January 12, 2025 at 8:26 amI’m sorry if my example was technically incorrect. I’m not a lawyer or law student. Maybe we can take another example like, we have freedom of speech but it does not mean we can use that to defame others, or speak ill of someone to hurt them. In that way, our right is limited in a way that it does not bother someone else. This is what I’m trying to say.

January 11, 2025 at 3:14 pmDon’t raise your blood pressure for such a petty issue. CCTV microphones are NOT THAT SENSITIVE, it will barely record any noise from your flat IF YOU KEEP doors & windows closed.Another idea:
1. Download SCREECHING NOISE online (a long clip 10 minutes or higher) and store on a cheap Micro SD card.
2. Buy a bluetooth speaker, cheap chinese ones with sd card slots. Keep it connected to a charger 24×7 and place it in your balcony inches away from their CCTV camera.
3. Blast the noise at medium volume 24×7 near the speaker and your privacy will be restored. The mic will pick up the high frequency screeching noise and won’t be able to record other sound frequencies from your home.

January 11, 2025 at 5:19 pmThe lack of clear laws on this subject really makes it most annoying. As on date, we do not have clear privacy laws to address this situstion. File a Civil Suit for permanent and mandatory injunction seeking directions against the the ahole to remove the cam. Make all allegations of breach of privacy, violation of Article 21, threat to security. The Judge might threaten the ahole to remove the cams. -
